中国古代任官回避制度研究

【摘要】:从汉代开始,为了避免官员徇私枉法、私相勾结,干政专权,威胁皇权,在官员的选拔、任命方面,统治者推行任官回避制度,通过官员回避籍贯、亲属子弟以及后来发展起来的科场回避,来实现规避官员相互勾结,维护封建统治,加强中央集权的目的。历代王朝对任官回避制度的具体内容有不同规定,大致分为三种类型:籍贯(地区)回避、亲属回避、科场回避。中国封建社会的本质决定任官回避制度性质,其实质无法从根本上做到完全的官场的公平,但中国古代任官回避制度为现代中国的公务员留下了极其珍贵的历史经验,为我国现代公务员回避制度提供了很好的借鉴。研究中国古代任官回避制度,吸取其中可以为今所用的政策规定,有利于为现代公务员提供良好的工作环境,更有助于推动公务员回避制度的不断完善,加快全面依法治国的进程。
[Abstract]:Since the Han Dynasty, in order to prevent officials from bending the law for personal gain, colluding with others, meddling in political power, and threatening imperial power, in the selection and appointment of officials, the rulers carried out the system of disqualification of officials and avoided their place of origin through officials. Relatives and children and the later development of the branch field to avoid officials colluding to maintain feudal rule and strengthen centralization of power. The past dynasties have different provisions on the specific contents of official withdrawal system, which can be divided into three types: local (regional) avoidance, kinship avoidance, and branch field avoidance. The essence of the feudal society in China determines the nature of the system of official evasion, which cannot fundamentally achieve the fairness of the official field. However, the system of official avoidance in ancient China left a precious historical experience for the civil servants in modern China. It provides a good reference for the modern civil servant avoidance system in our country. To study the system of official withdrawal in ancient China, to absorb the policy provisions that can be used for the present, is conducive to providing a good working environment for modern civil servants, and is also conducive to promoting the continuous improvement of the system of avoidance of civil servants. We will speed up the process of governing the country according to law.
