城乡一体化背景下弱势群体的养老保险法律制度研究

【摘要】：近年来,我国加大城乡一体化进程,城乡在生态、经济、社会保障及福利等各个方面逐步实现一体化,其中,养老保险制度的不断更新发展作为社会保障及福利一体化的一个重要部分不容被忽视。但是,在进程中,有一部分群体因为自身健康缺陷及经济条件的相对薄弱,一直处于社会较低层,被归为弱势群体。这部分群体的养老保险缺乏适合的、完善的法律保护,导致了这部分群体在达到申领年龄之时,享受养老保险福利的人数比例较低,难以实现实质意义上的公平正义。针对这种情况,本文结合国内外在城乡一体化背景下弱势群体的养老保险的法律制度研究成果,以我国各地区不同的养老保险措施为视角,对弱势群体的养老保险法律保护存在的主要问题进行了归纳分析,并提出相应的建议。文章主要分为五章:第一章:对本课题的相关研究背景、国内外研究综述、研究目的、研究意义、研究方法,分别进行阐述。第二章:对城乡一体化、弱势群体及四类特殊群体、养老保险的概述。本章主要包含:城乡一体化内涵介绍,弱势群体的定义及研究范围选择原因,及简介养老保险制度及其法学层面内涵。第三章:对弱势群体养老保险的实证分析。本章首先通过分别介绍我国各个地区关于四类弱势群体的养老保险制度,以便对各地区各类型的制度进行比较,从而得出各类制度的优势与劣势。其次,通过分别介绍经济发展程度不同的三类国家的弱势群体的养老保险,并与我国进行对比,从而找寻借鉴经验。第四章:对我国城乡一体化背景下,弱势群体的养老保险法律保护制度在实践过程中出现的问题,进行原因分析。主要内容包含:立法机制缺陷、激励机制缺陷、反馈机制缺陷、及参保压力的具体分析。第五章:根据相关的缺陷及原因,提出完善建议。本章首先,确定完善的原则,提出实现实质性平等的要求,再次根据以上提出的缺陷及对应原因,一一提出针对性完善建议。
[Abstract]:In recent years, China has stepped up the process of urban-rural integration, gradually realizing the integration of urban and rural areas in ecological, economic, social security and welfare aspects, among which, As an important part of the integration of social security and welfare, the continuous updating and development of the old-age insurance system should not be ignored. However, in the process, some groups, because of their own health defects and relatively weak economic conditions, have been in the lower level of society, is classified as a vulnerable group. This part of the pension insurance lack of appropriate, perfect legal protection, resulting in this part of the group at the age of application, the proportion of people enjoying pension insurance benefits is relatively low, it is difficult to achieve the substantive sense of fairness and justice. In view of this situation, this article combines the domestic and international research results of the legal system of pension insurance for the disadvantaged groups in the context of urban-rural integration, taking different pension insurance measures in various regions of our country as the perspective. This paper sums up and analyzes the main problems existing in the legal protection of endowment insurance for vulnerable groups, and puts forward corresponding suggestions. The article is divided into five chapters: the first chapter: the related research background, domestic and foreign research review, research purpose, research significance, research methods, respectively. Chapter two: an overview of urban and rural integration, vulnerable groups and four special groups. This chapter mainly includes: the connotation of urban-rural integration, the definition of vulnerable groups and the choice of research scope, as well as the endowment insurance system and its legal connotation. Chapter three: the empirical analysis of pension insurance for vulnerable groups. This chapter firstly introduces the pension insurance system of four kinds of vulnerable groups in different regions of our country respectively, so as to compare the different types of systems in different regions, and then get the advantages and disadvantages of all kinds of systems. Secondly, by introducing the pension insurance of the vulnerable groups in the three kinds of countries with different degree of economic development, and comparing it with our country, we can find out the experience for reference. The fourth chapter analyzes the causes of the problems in the practice of the legal protection system for the disadvantaged groups under the background of urban-rural integration. The main contents include: legislative mechanism defect, incentive mechanism defect, feedback mechanism defect, and the concrete analysis of participating insurance pressure. The fifth chapter: according to the related defects and reasons, put forward the perfect suggestions. First of all, this chapter determines the principle of perfection, puts forward the requirement of realizing substantive equality, and then puts forward some suggestions according to the defects and corresponding reasons mentioned above.
