联合国维和行动中的违法问题及对策探析

【摘要】： 作为世界上规最大、最具影响力的政府间国际组织,联合国对人类和平与安全负有特殊的责任。联合国维持和平行动(United Nation Peace—Keeping Operation)是联合国根据《联合国宪章》的宗旨和原则精神,在协调、解决国际争端的实践中逐渐形成和发展起来的。60多年以来,维和行动在维护世界和平中发挥了重要作用。联合国维和行动经过初创、发展、停滞和再发展阶段,目前己经日渐走向成熟。在联合国成立后的大部分时间里,冷战和一些国家殖民主义的作用实际上使联合国安理会处于瘫痪状态。80年代末期,冷战结束和苏联解体形成了新的国际政治格局。美国成为唯一的超级大国。由于东西方关系大大缓和,联合国的作用与日俱增。联合国维和行动的次数剧增、规模不断扩大、职能不断增加。维和行动进入了联合国成立以来最为活跃的时期。联合国维和行动为维护世界和平与稳定付出了很大努力,取得了巨大的成就,这一点得到了世界人民的肯定和赞扬。但是,由于当今世界上大国霸权主义、新干涉主义等因素的存在,一些大国强国试图操纵联合国,借助维和行动的名义去实现自己的利益,推行自己的价值观。这就使得联合国在一些维和行动中偏离了维和行动的宗旨,甚至还出现了维和行动中部分干涉别国内政和滥用武力的情况,严重违背了联合国宪章和维和行动原则,甚至还违反了相关国际法的规定,这不仅使维和行动的效果大打折扣,还使人们对联合国维和行动的宗旨产生了质疑,严重损坏了联合国的声誉。联合国维和行动虽然充满了坎坷和曲折,但是仍将不断向前发展。一些影响联合国维和行动的不利因素在人类的共同努力下终将全面解决。
[Abstract]:As the largest and most influential international intergovernmental organization in the world, the United Nations has a special responsibility for the peace and security of mankind.United Nations Nation Peace-Keeping Operation is a process in which the United Nations, in accordance with the purposes and principles of the Charter of the United Nations, has evolved and developed in the practice of coordination and settlement of international disputes for more than 60 years,Peacekeeping operations have played an important role in maintaining world peace.The UN peacekeeping operation has matured gradually through the stage of start-up, development, stagnation and redevelopment.For most of the time after the founding of the United Nations, the role of the cold war and colonialism in some countries actually paralyzed the UN Security Council in the late 1980s, and the end of the Cold War and the disintegration of the Soviet Union formed a new international political pattern.The United States became the sole superpower.The role of the United Nations has increased as relations between East and West have eased considerably.The number, scale and functions of UN peacekeeping operations have increased dramatically.Peacekeeping operations have entered the most active period since the founding of the United Nations.Un peacekeeping operations have made great efforts and made great achievements in safeguarding world peace and stability, which has been acknowledged and praised by the people of the world.However, due to the existence of hegemonism and neo-interventionism in the world today, some great powers try to manipulate the United Nations, use the name of peacekeeping operations to realize their own interests and carry out their own values.This has caused the United Nations to deviate from the purpose of peacekeeping operations in some peacekeeping operations, and there has even been some interference in the internal affairs of other countries and indiscriminate use of force in peacekeeping operations, which seriously violates the Charter of the United Nations and the principles of peacekeeping operations.It even violates the provisions of relevant international law, which not only greatly reduces the effectiveness of peacekeeping operations, but also makes people question the purpose of United Nations peacekeeping operations and seriously damages the reputation of the United Nations.Although UN peacekeeping operations are full of ups and downs, they will continue to move forward.Some adverse factors affecting UN peacekeeping operations will eventually be comprehensively resolved through the joint efforts of mankind.
