论关于海盗的国际法规则及其发展

【摘要】: 近年来,日益严重的海盗犯罪直接着威胁船员生命与财产安全,给国际航运业造成巨大的经济损失,严重扰乱了国际社会的正常秩序,这要求国际社会必须及时完善国际海盗的国际法规则,维护国际海运的安全及相关海域的稳定。有鉴于此,笔者希望通过系统性的梳理和探讨,对打击海盗的国际法规则问题做出些许研究和贡献。本文分析了目前已有的针对海盗的国际法规则,解读该等国际法规则的内涵及存在的问题,结合当前打击海盗方面理论上和实践上的新的发展趋势,为打击海盗的国际法规则的完善和发展提供一定的法律策略和建议。 本文共分为导言、正文、结语三个部分,其中正文由五章组成。 第一章简述了海盗的发展历史。首先,介绍了海盗从古希腊至现代的发展简史,并归纳了现代海盗对比传统海盗所具有的新特点;其次,分析了海盗行为对生命与财产安全、国际航运及环境的巨大危害。 第二章介绍了打击海盗的法律规范。首先,总结归纳了打击海盗的国际法规范发展进程,列举一系列的涉及打击海盗的国际法规范,并分析了相关国际法规范的内容、局限性及进步之处;其次,介绍了具有典型意义的国家制定的针对海盗的国内法规范,并提出在国内法层面上规定海盗罪,有助于国际法和国内法的有效衔接,从而将抓捕的海盗送归国内法院进行审理。 第三章分析了《联合国海洋法公约》相关内容在打击海盗方面存在的局限性。首先,分析了《联合国海洋法公约》对海盗的定义及局限性,并提出对《联合国海洋法公约》中海盗罪的定义及其构成条件进行完善及发展的观点;其次,分析了针对海盗的普遍管辖权,本部分介绍了普遍管辖权的概念、普遍管辖权原则在打击海盗行为中的确立历程,并指出了《联合国海洋法公约》规定的普遍管辖权在打击海盗方面存在的争议及问题;第三,分析了针对海盗的紧追权问题,主要介绍了紧追权概念、《联合国海洋法公约》对紧追权的规定以及《联合国海洋法公约》确立的紧追权在打击海盗过程中存在的局限性。 第四章分析了针对海盗的跨国护航问题。首先,介绍了护航的起源、概念;其次,着重分析了跨国护航产生的国际法问题、为打击海盗从事跨国护航的必要性与可行性;最后,简单介绍了各国在索马里海域护航情况。 第五章分析了打击海盗国际法规则的发展。根据上文指出的涉及打击海盗国际法规则存在的问题,并结合近来最新的发展趋势,笔者提出了完善和发展相关国际法规则的建议。首先,提出对《联合国海洋法公约》中海盗的定义、紧追权以及解决管辖权冲突等问题完善的建议;其次,针对各国在索马里海域跨国护航的实践,提出可制定相关的跨国护航的国际法规范,使跨国护航有序进行。
[Abstract]:In recent years, the increasingly serious crime of piracy has directly threatened the safety of crew life and property, caused enormous economic losses to the international shipping industry, and seriously disturbed the normal order of the international community. This requires the international community to improve the rules of international piracy in time, to maintain the security of international maritime transport and the stability of the relevant waters. In view of this, the author hopes to make some research and contribution to the international law rules of anti-piracy through systematic combing and discussion. This paper analyzes the existing rules of international law against pirates, interprets the connotation and existing problems of these rules of international law, and combines with the new development trend in theory and practice in the field of anti-piracy. This paper is divided into three parts: introduction, text and conclusion. The text is composed of five chapters. The first chapter describes the history of piracy. First of all, it introduces the development history of pirates from ancient Greece to modern times, and summarizes the new characteristics of modern pirates compared with traditional pirates. Secondly, it analyzes the safety of piracy to life and property. International shipping and great harm to the environment. Chapter two introduces the legal norms of anti-piracy. First of all, it summarizes the development process of international law norms against piracy, enumerates a series of international law norms related to the fight against piracy, and analyzes the content, limitations and progress of relevant international law norms; secondly, Introducing the norms of domestic law against piracy developed by countries of typical significance, and proposing that the establishment of the crime of piracy at the level of domestic law is conducive to the effective convergence of international law and domestic law, The third chapter analyzes the limitations of the relevant contents of the United Nations Convention on the Law of the Sea in the fight against piracy. Firstly, it analyzes the definition and limitation of piracy in the United Nations Convention on the Law of the Sea, and puts forward the viewpoint of perfecting and developing the definition of piracy and its constituent conditions in the United Nations Convention on the Law of the Sea. This part introduces the concept of universal jurisdiction, the establishment of the principle of universal jurisdiction in the fight against piracy, It also points out the disputes and problems of universal jurisdiction under the United Nations Convention on the Law of the Sea in the fight against piracy; thirdly, it analyzes the issue of the right of hot pursuit against pirates, This paper mainly introduces the concept of the right of tight pursuit, the provisions of the United Nations Convention on the Law of the Sea on the right of tight pursuit, and the limitations of the right of tight pursuit established by the United Nations Convention on the Law of the Sea in the process of anti-piracy. The question of transnational escort. First of all, the origin and concept of escort are introduced. Secondly, the international law problems arising from transnational escort are analyzed. In order to combat piracy, it is necessary and feasible to engage in transnational escort. In chapter 5, the development of international rules of anti-piracy is analyzed. On the basis of the problems mentioned above concerning the rules of international law against piracy and the recent development trend, the author puts forward some suggestions for perfecting and developing the relevant rules of international law. First of all, it puts forward some suggestions on the definition of piracy in the United Nations Convention on the Law of the Sea, the right of hot pursuit and the resolution of conflicts of jurisdiction. Secondly, it aims at the practice of transnational escort of States in the waters of Somalia. The relevant international norms of transnational escort can be formulated to make the international escort proceed in an orderly manner.
