欧洲一体化中的差异性:以申根区临时恢复内部边境管制为例

【摘要】：申根合作是欧洲一体化建设的重要成果,也是差异性发展最为显著的领域。本文以申根法则的豁免条款——临时恢复内部边境管制条款为例,分析了该差异性条款的内容和实施情况,探讨了欧盟修订相关条款的动因、过程和结果,并指出欧盟机构与成员国围绕修订条款产生的分歧实质上是超国家主义和政府间主义之争。修订后的条款存在的问题和成员国差异性的利益诉求仍将导致该特殊例外的滥用难以避免,将可能强化申根合作的差异性发展趋势。
[Abstract]:Schengen cooperation is an important achievement of European integration construction, and is also the most significant area of differential development. This paper takes the exemption clause of Schengen rule-temporary restoration of internal border control clause as an example, analyzes the content and implementation of the difference clause, and probes into the motivation, process and result of the revision of the relevant articles by the European Union. It also points out that the differences between EU institutions and member states over the revised terms are essentially the disputes between supranationalism and intergovernmentalism. The problems existing in the revised clause and the different interests of the member states will still lead to the abuse of the special exception, which may strengthen the development trend of Schengen cooperation.
