论国际因素的合法化机制——以地方治理创新为例

【摘要】：随着中国与世界联系的日益紧密、全面,国际因素已经成为国内治理变革中不可忽视的变量,利益、制度和知识是国际因素的三种基本形式。作者扩展了合法化概念,提出国际因素介入国内治理变革需要获得国内利益主体的接受和承认,中央权威、地方权威和社会公众是三个基本主体,因此有三种获得合法性的基本机制,即国家合法化机制、地方合法化机制和社会合法化机制。作者通过对行政审批、立法听证和政府绩效评估三个政府治理创新案例的分析,描绘了利益、制度和知识三类国际因素介入地方治理创新的过程、影响以及结果。虽然不同类型的国际因素介入地方治理过程依靠的是不同的合法化机制组合,但都需要在介入之前或者介入过程中通过国家权威获得合法性。随着地方和社会自主性的提高,国际因素通过地方合法化机制和社会合法化机制产生的实际效果更大,但这两种机制也可能会与国家合法化机制产生矛盾。提高国家合法化机制的开放性和包容度有助于减少合法化机制之间的矛盾和冲突。
[Abstract]:With the increasingly close and comprehensive relationship between China and the world, international factors have become the variables that can not be ignored in the reform of domestic governance. Interests, institutions and knowledge are the three basic forms of international factors. The author expands the concept of legalization, and points out that international factors involved in the reform of domestic governance need to be accepted and recognized by the domestic stakeholders. The central authority, the local authority and the public are the three basic subjects. Therefore, there are three basic mechanisms for obtaining legitimacy, namely, the national legalization mechanism, the local legalization mechanism and the social legalization mechanism. By analyzing three cases of government governance innovation such as administrative examination and approval, legislative hearing and government performance evaluation, the author describes the process, influence and results of three international factors, interest, institution and knowledge, involved in local governance innovation. Although different types of international factors intervene in the process of local governance depend on different combinations of legalization mechanisms, but they all need to obtain legitimacy through state authority before or during the process of intervention. With the improvement of local and social autonomy, the actual effect of international factors is greater through local legalization mechanism and social legalization mechanism, but these two mechanisms may also produce contradiction with national legalization mechanism. Increasing the openness and tolerance of the national legalization mechanism can help to reduce the contradiction and conflict between the legalization mechanism.
