试论奥古斯都的道德法令

【摘要】：本文从罗马共和国向帝国转变的历史背景分析出发，综合研究奥古斯都的道德法令，并以反通奸法和婚姻法为中心展开论述。首先，文章从政府、社会、法令、道德入手，分析道德法令颁布的历史背景，揭示其中深刻的变化，以此作为线索要素展开接下来的综合论述。然后，进一步综合论述奥古斯都制定道德法令的原因，其中包括社会权威与政府权力相互混淆、相互博弈对于元首统治的作用和意义，以及奥古斯都如何试图以道德法令重建社会秩序和维护罗马在地中海世界的统治。其次，，本文对道德法令中关于反通奸法和婚姻法的内容进行重点解读，并对其中政府法令监管社会道德的具体史实做较深入的分析。最后，在论述道德法令所取得实效基础上，探讨道德法令最终难以取得成功的原因。而原因正是在于政府监管目标和社会自治愿望之间的矛盾。总之，本文试图以一种新的视角，从分析道德法令中的反通奸法和婚姻法入手，考察罗马政府与社会之间的关系，比较深入地探讨罗马历史变革中的政府、社会、法律、道德等方面的一些重点问题。
[Abstract]:Based on the analysis of the historical background of the transformation from Roman Republic to Empire, this paper makes a comprehensive study of Augustus' moral decrees, and focuses on the anti-adultery law and marriage law. First of all, starting with the government, society, decrees and morality, this paper analyzes the historical background of the promulgation of moral decrees, reveals the profound changes in them, and takes this as a clue to carry out the next comprehensive discussion. Then, it further discusses the reasons why Augustus made moral decrees, including the confusion between social authority and government power, and the role and significance of mutual game to the rule of the head of state. And how Augustus tried to re-establish social order and preserve Rome's rule in the Mediterranean world by moral decrees. Secondly, this paper mainly interprets the contents of anti-adultery law and marriage law in moral decrees, and analyzes the specific historical facts of the supervision of social morality by government decrees. Finally, on the basis of discussing the effectiveness of moral decrees, this paper discusses the reasons why moral decrees are difficult to succeed in the end. And the reason lies in the contradiction between the goal of government supervision and the desire of social autonomy. In a word, this paper attempts to explore the relationship between Roman government and society from a new angle of view, starting with the analysis of anti-adultery law and marriage law in moral decrees, and probes into the government, society and law in Roman historical changes. Some of the key issues in morality and so on.
