南宋新型军正制度与基层治安管理之创新

【摘要】：军正是汉代军中的执法官,汉代以后一度消亡,以至有学者说汉代以后不见军正之名。实际上,在南宋时期,军正却以另一种形式出现,即县域民兵武装最高统帅。南宋军正制度是在内外交困的大背景下形成的,前期主要存在于沿边路份,后期逐渐推广到全国,成为维护基层治安的一项重要制度。该制度是政府与地方豪族利益博弈与共生的结果,既默许了豪族控制民兵武装的现实,又将相对独立的民兵武装纳入了国家统治体制,成为国家与地方豪族之间利益的平衡机制,可以说是一项相当成功的制度创新。
[Abstract]:The army was the law enforcement officer in the Han Dynasty, which died out after that time, so that some scholars said that the Han Dynasty had lost its name. In fact, in the Southern Song Dynasty, the army was in another form, that is, the county militia armed supreme commander. The military system of the Southern Song Dynasty was formed under the background of internal and diplomatic difficulties. In the early stage, it mainly existed along the side road, and gradually extended to the whole country in the latter stage, and became an important system for maintaining public order at the grass-roots level. This system is the result of the game and symbiosis between the government and the local people, which not only acquiesced in the reality of controlling the militia, but also brought the relatively independent militia into the national ruling system. It can be said that it is a successful institutional innovation to balance the interests between the state and the local aristocrats.
