《唐律疏议》中的“及”字例析——传统中国的立法技术一瞥

【摘要】：展现中国古代立法技术的"八字例"中,包括"及"字。唐律以"及"字分隔特定内容,其适用情形可分为两类:一是开放式地列举典型事项以描述大略,常见于对人、事、物的解释说明;二是穷举各种可能以限定范围,常见于描述行为及多个行为人之间相互牵连的关系。定律广泛使用"及"字,而不拘泥于"同罚"。律条中用"及"字,符合"互文省文之法",体现轻重权衡之理,集连贯与分类效应于一字中,提示异质同构、异事同罚的条件性。律典中所用的"及"字,往往是在含混列举与准确分隔之间切换,体现了法律用语在细致与简约中求取平衡。
[Abstract]:The eight-character examples of ancient Chinese legislative techniques include "and". Tang law separated the specific content by the word "and", its application can be divided into two categories: first, open enumeration of typical items to describe the general strategy, common in the interpretation of people, things, things; The second is to enumerate various possibilities and limit the scope, often in describing the behavior and the relationship between multiple actors. The word "and" is widely used in the law and is not confined to the word "punishment." The use of the word "and" in the rule accords with "the method of intertextuality", which embodies the principle of weight and weight balance, and sets coherence and classification effects in one word, indicating the conditionality of heterogeneity and isomorphism and punishment of different things. The word "and" used in the law code is often switched between vague enumeration and accurate separation, which reflects the balance of legal terms in detail and simplicity.
