【摘要】:正秦朝二世而亡的短祚命运,吸引了其后历代人们的深切反思。汉人认为秦亡的原因是法家思想指导下的暴政,其中以贾谊的《过秦论》为代表,他提出"仁义不施而攻守之势异也"(《史记·秦始皇本纪》,中华书局1982年版,第282页)。法家思想导致秦亡也因此成为两千多年来的话题,直至今日,持此种观点的仍不乏其人。如刘仲一认为秦王朝是建立在法家思想理论基础之上的,法家思想的核心是暴力主义原则,秦统一后短促而亡,法家思想难辞其咎(《法家思想与秦朝的速亡》,《求是学刊》1998年第3期)。李慧娟也认为法家思想是秦国治国的主导
[Abstract]:The fate of the death of the second Emperor of the Qin Dynasty attracted the deep reflection of the later dynasties. Han people believed that the reason for Qin's death was the tyranny under the guidance of Legalist ideology. Among them, Jia Yi's "the Theory of passing the Qin Dynasty" as a representative, he put forward that "the tendency of attacking and defending is different when benevolence and righteousness do not act" (History Records Qin Shihuang, 1982 edition, p. 282). The thought of legalism resulted in the death of Qin Dynasty, which has become a topic for more than two thousand years. To this day, people still hold this view. For example, Liu Zhongyi believed that the Qin Dynasty was based on the theory of Legalism, the core of which was the principle of violence. After the unification of the Qin Dynasty, the legalist thought could hardly be absolved from the blame ("Legalist thought and the rapid fall of the Qin Dynasty"). Qiushi Journal, No. 3, 1998. Li Huijuan also thinks that the thought of legalism is the leading role of governing the country in Qin Dynasty.
