殷周法律公布形式论考

【摘要】：中国早在殷周时期不仅已经形成了公布法律的传统,而且已经形成了较为固定的法律公布形式。以诰、宪刑与悬书的方式公布法律,是殷周时期比较常见的做法。不仅如此,在法律公布之后,早期王朝往往还要通过木铎宣传的形式将法令广播四方,使民众知悉法律的内容,不致误触刑网。
[Abstract]:As early as the Yin and Zhou dynasties, China has not only formed the tradition of publishing laws, but also formed a more fixed form of legal publication. It is a common practice in Yin and Zhou dynasties to publish laws in the form of Letters Patent, constitutional punishment and hanging letters. Not only that, after the publication of the law, the early dynasties often had to broadcast the decree in the form of Mudor propaganda, so that the people knew the content of the law and did not miss the punishment net.
