基于权利的社会建构陷入了困境

【摘要】：近代以来的社会,或者说我们既已拥有的社会,是基于权利的设定建构起来的,民主政治无非是在从权利出发的社会建构逻辑中演变出来的结果。权利包含着平等和自由的内涵,但是,无论在理论上还是在实践上,平等和自由都包含着悖论。就社会治理而言,在自由主义的框架下是出于维护和保障权利的目的,而在实际运行中,处处要求人们放弃权利。应当承认,基于权利设定而建构起来的社会,在300多年的运行中取得了辉煌成就,但在20世纪后期则呈现出风险社会的特征,从而决定了全球化、后工业化进程将是一场社会重建的运动。在思考社会重建的问题时,必须实现出发点和思维方式上的根本性变革。我们需要放弃从权利出发去建构社会的逻辑,而是需要从人的共生共在出发;我们不应再借助于分析性思维寻求同一性,而是需要运用相似性思维去谋求人的差异前提下的共同行动。
[Abstract]:The society in modern times, or the society we have already owned, is based on the set of rights. Democracy is the result of the evolution of social construction logic from rights. Rights contain the connotation of equality and freedom. However, both in theory and in practice, equality and freedom contain paradoxes. As far as social governance is concerned, under the framework of liberalism, it is out of the purpose of safeguarding and protecting the rights, and in the actual operation, people are required to give up the rights. It should be acknowledged that the society built on the basis of rights has been brilliant in the operation of 300 years, but in the late twentieth Century it showed a special risk society. The process of post industrialization will be a movement of social reconstruction. In thinking of the problem of social reconstruction, we must realize the fundamental change in the starting point and the way of thinking. We need to give up the logic of building the society from the right to construct the society, but we need to start from the co-existence of human beings; we should not use any more points. Analytical thinking seeks identity, but requires similar thinking to seek common action under the premise of human differences.
