先秦儒家政治正义理念研究

【摘要】:政治正义是政治哲学的核心问题,历来受到中外政治思想家的普遍关注。先秦儒家思想拥有丰富的政治正义理念。本文对先秦儒家政治正义理念的核心范畴—“义”及相关范畴进行阐释,“义”的具体内涵体现在:正当性、正义性与公平正直性。先秦儒家将其提升到个体行为准则的层面,实现政治正义社会化。 本文从观念正义和制度正义两个角度对先秦儒家政治正义理念的主体内容进行了阐述。从观念正义的角度来看,儒家关于人性平等的假设包含着基本权利平等思想,,儒家关于“选贤与能”、善待弱势群体等主张,体现了“天下为公”理念;从制度正义的角度来讲,儒家主张以“定分”为前提、以促“和”为目的的礼治主义。这两方面的内容缺一不可,共同构成了先秦儒家政治正义理念的主体内容。 本文对先秦儒家政治正义理想的实现路径进行分析。儒家对政治正义的追求有三个具体途径:首先,“为政必先正名”,“正名”即确定名分或者名位,这是一种政治身份与政治地位的象征;其次,行礼治与施法治的有机结合;第三,对于政治官吏的选拔即政治权力的分配,坚持赏贤使能政策。 对先秦儒家政治正义理念的评价是本文的一个重要内容。先秦儒家提出的政治正义构想对于我国封建时代的政治生活曾起到一定的积极作用;但是,其历史局限不容忽视,即重身份正义,强调等级原则;重道德约束,轻制度保障。 先秦儒家政治正义理念中的合理内容在当代也具有一定的积极意义,如柔性道德与刚性法制的互补思想、个体正义与“天下为公”相结合观念,都值得我们认真加以研究和进行创造性转化。借鉴先秦儒家政治正义理念,促进当代政治正义的发展,对我国建设社会主义和谐社会具有重要的价值。
[Abstract]:Political justice is the core issue of political philosophy, which has always received widespread attention from Chinese and foreign political thinkers. Pre-Qin Confucian thought has abundant political justice idea. This paper explains the core category of the political justice of the pre-Qin Confucianists-"righteousness" and its related categories. The concrete connotation of "righteousness" is embodied in: legitimacy, justice and fairness and integrity. The pre-Qin Confucianists promoted it to the level of individual code of conduct to realize the socialization of political justice. This paper expounds the main content of the political justice idea of pre-Qin Confucianism from two angles of concept justice and system justice. From the point of view of concept justice, the hypothesis of human equality of Confucianism contains the thought of equality of basic rights. The Confucian ideas of "selecting talents and ability" and being kind to the vulnerable groups reflect the idea that "the world is common to people". From the point of view of system justice, Confucianism advocates the propriety rule with the premise of "definite division" and the purpose of promoting "harmony". These two aspects are indispensable and constitute the main content of the political justice idea of the pre-Qin Confucianism. This paper analyzes the way to realize the ideal of political justice in pre-Qin Confucianism. The pursuit of political justice by Confucianism has three specific ways: first, "must first correct the name for politics", "correct name" is to determine the rank or place, this is a kind of symbol of political identity and political status, secondly, the combination of propriety and rule by law; Third, the selection of political officials, that is, the distribution of political power, adhere to the policy of merit. It is an important content of this paper to evaluate the political justice idea of pre-Qin Confucianism. The conception of political justice put forward by the pre-Qin Confucianists had played a positive role in the political life of the feudal era of our country; however, its historical limitations could not be ignored, that is, attaching importance to identity justice, emphasizing the principle of hierarchy, attaching importance to moral constraints, and neglecting the guarantee of the system. The reasonable content of the political justice idea of the pre-Qin Confucianism also has certain positive significance in the contemporary times, such as the complementary thought of soft morality and rigid legal system, the combination of individual justice and "the world is common to people". Are worthy of our careful study and creative transformation. It is of great value for our country to build a harmonious socialist society by referring to the political justice idea of pre-Qin Confucianism and promoting the development of contemporary political justice.
