重新理解罗尔斯的契约论

【摘要】：提起罗尔斯的契约论,人们通常会想起那个著名的原初状态论证。然而,在罗尔斯的契约论框架中,具有根本意义的是良序社会而非原初状态的观念。原初状态是对良序社会的模拟和表征,原初状态的证成力量依赖于良序社会观念的吸引力。说罗尔斯的证成方式是契约论的,主要是因为他将良序社会中合理而理性的公民的同意,当作制度证成的标准;而制度证成的两个维度:正义和稳定,通过公民的两个视角先后得到检验。通过良序社会的观念重构契约论证,有助于我们消除对于罗尔斯理论的一些误解。
[Abstract]:When it comes to Rawls' theory of contract, the famous argument of primordial state is often recalled. However, in the framework of Rawls' contract theory, it is the concept of good order society rather than the original state that has fundamental significance. The primordial state is the simulation and representation of the well-ordered society, which depends on the attractiveness of the concept of the well-ordered society. Rawls' way of proving is contractual theory, mainly because he regards the consent of reasonable and rational citizens in the well-ordered society as the standard of institutional evidence; The two dimensions of institutional evidence, justice and stability, have been tested successively from the two perspectives of citizens. It is helpful for us to eliminate some misunderstandings about Rawls' theory through the reconstruction of contract argument by the concept of well-ordered society.
