孟德斯鸠笔下的家庭秩序与政府类型

【摘要】：家庭秩序作为"法的精神"的一部分,在孟德斯鸠的著作中具有独特的地位,同时也显现出了很大的张力。他一方面强调家庭秩序对政治体的稳固起到关键作用,无论专制政府还是共和政府都是如此;但另一方面,他又指出,君主政府之下的家庭秩序,特别是女性地位发生了很大的变化。他认为,这是与君主政府的原则相契合的,并不会对君主政府造成任何伤害,反而使其受益。从婚姻和家庭价值的变化、女性自由,以及家庭权威与公民教育的关系三个层面来看,孟德斯鸠对家庭秩序截然不同的态度与其政府分类原则之间有着紧密的关系。
[Abstract]:As a part of the Spirit of Law, family order has a unique position in Montesquieu's works and shows great tension at the same time. On the one hand, he stressed that family order plays a key role in the stability of the political body, both autocratic and Republican governments, but on the other hand, he pointed out that great changes have taken place in the family order under the monarch government, especially in the status of women. In his view, this is in line with the principles of the monarchy and will not cause any harm to the monarchy, but will benefit it. From three aspects: the change of marriage and family value, the freedom of women, and the relationship between family authority and civic education, Montesquieu's attitude towards family order is closely related to the principle of government classification.
