元代收养制度研究

【摘要】：收养制度 ,为中国古代社会亲属关系的一项重要制度 ,在此基础上 ,收养人与被收养人之间构成拟制亲属关系。在中国古代社会 ,由于收养制度主要是基于家本位、族本位和父系本位而产生 ,故其目的、范围与基本原则等都与现代收养制度迥异。本文结合元代收养制度的法律规定 ,对当时社会生活中的收养关系及其特点进行了一些初步研究 ,并探讨了当时与收养关系有关的一些社会问题。
[Abstract]:Adoption system is an important system of kinship relationship in ancient Chinese society. On this basis, the adopter and the adoptee constitute fictitious kinship relationship. In ancient Chinese society, the adoption system was mainly based on the family standard. The purpose, scope and basic principles of the clan standard and paternal standard are different from the modern adoption system. This paper combines the legal provisions of the Yuan Dynasty adoption system. This paper makes some preliminary studies on the adoptive relationship and its characteristics in the social life at that time, and probes into some social problems related to the adoptive relationship at that time.
