生态整体性视野下我国环境监管体制研究

【摘要】:我国对环境保护的重视已经达到一定的高度,但是,反观近些年来我国环境恶性事件频发,环境监管缺失被推到公众的视野中。环境自身具有综合性、复杂性,环境监管如何可以进行有效监管,必然应符合生态整体性的概念。目前我国环境监管法律仍不够完善,还不足以应对我国日渐频发的环境问题。新《环境保护法》给予的环境监督管理回应并不能完全的适用于我国复杂的环境问题。所以,有必要从理论上对这一问题的思考方式重新加以检讨,并为我国寻求较为适宜的环境监管体制。鉴于此,本文以生态整体性思维,对我国的环境监管体制展开探讨。全文分为四个部分:第一部分是生态整体性及环境监管法律制度现状分析,不仅阐述我国环境监管模式及环境监管立法现状,还说明采用生态整体性思维对改善我国环境监管体制的必要性。第二部分是对国外环境监管法律制度的探讨,总结其他国家就环境整体监管问题上的解决方法,并学习其整体监管的经验。第三部分是对我国环境监管法律制度,所存在的问题进行分析。即环境整体监管立法不完善、环境部门及其他部门之间协调机制不完备、环境监测的区域协调机制不完善、区域联防联治机制不完善以及城乡环境监管二元化五个问题。第四部分是针对以上五个问题,总结分析得出相应对策。第一,促进不同法律之间的协调性;明确政府责任。第二,对环境部门及其他部门进行职能整合。第三,促进监测信息交流共享:完善监测合作机制。第四,完善区域联防联治机制。第五,促进城乡环境监管一体化。
[Abstract]:The importance of environmental protection has reached a certain level in China. However, in recent years, environmental incidents in China are frequent. The lack of environmental supervision has been pushed to the public view. The environment itself is comprehensive and complex, and how environmental supervision can be effectively regulated. It must conform to the concept of ecological integrity. At present, our country's environmental regulation law is still not perfect enough, and it is not enough to deal with the increasingly frequent environmental problems in China. The environmental supervision and management response given by the new environmental protection law can not be fully applied to the complex environmental problems in China. Therefore, it is necessary to review the way of thinking of this problem in theory, and to seek a more suitable environmental supervision system for our country. In view of this, this paper discusses the environmental supervision system in China based on the ecological holistic thinking. The full text is divided into four parts: the first part is the analysis of the entirety of the entirety and the environmental supervision legal system. It not only expounds the present situation of our environmental supervision mode and the environmental supervision legislation, but also explains the necessity of adopting the ecological holistic thinking to improve our environmental supervision system. The second part is to discuss the legal system of environmental supervision in foreign countries, summarize the solutions of other countries' environmental supervision and learn the experience of their overall supervision. The third part is the analysis of the existing problems in the legal system of environmental supervision in China. Between the environmental supervision legislation is not perfect, the overall environment and other departments coordination mechanism is not complete, the regional coordination mechanism for environmental monitoring is not perfect, the regional joint prevention mechanism is not perfect and the urban and rural environmental supervision two yuan five questions. The fourth part is aimed at the above five problems, summarizing and analyzing the corresponding countermeasures. First, to promote the coordination between different laws and to clarify the responsibility of the government. Second, the functional integration of the environmental departments and other departments. Third, promote the exchange and sharing of monitoring information: improve the monitoring cooperation mechanism. Fourth, improve the regional joint prevention mechanism. Fifth, to promote the integration of urban and rural environmental supervision.
