【摘要】:船舶污染问题业已引起社会各界的普遍关注。目前,对该问题的关注已不仅局限在原油、燃油、有毒有害危险物质带来的污染,而且拓展到包括船舶大气污染、船舶残骸清除在内的诸多方面。在此背景下,《国际防止船舶造成污染公约》出台了新的附件六——《防止船舶造成空气污染规则》。为响应公约的执行,中国、美国、欧盟等国家或地区纷纷出台相应的国内法。2015年,我国修订出台了《大气污染防治法》、《珠三角、长三角、环渤海(京津冀)水域船舶排放控制区实施方案》等系列法律法规,为减少船舶大气污染、建立我国船舶硫氧化物排放控制制度奠定了坚实基础。我国船舶硫氧化物排放控制制度建立伊始,学界对其的关注大多局限于浅层次、技术性、操作性的问题,例如对国内外相关法律法规的归纳总结、船舶排放控制区建立的应对及影响等。为深化我国船舶硫氧化物排放控制的讨论,完善船舶硫氧化物排放控制制度建设,本文从概述、现有制度、排污权交易、完善建议四个方面对"如何控制船舶硫氧化物排放"的问题予以分析。本文第一部分阐述了船舶硫氧化物的含义、国内外相关的控制制度;第二部分主要梳理了我国现有的船舶硫氧化物控制制度及其法律依据,并指出其中存在的不足;第三部分,为缓解船舶硫氧化物排放控制履约成本高与航运业发展低迷的矛盾,本章论述了两种不同规制环境问题的政策模式,探讨了在船舶排放控制区内建立排污权交易制度试点的必要性、可行性及存在的问题;最后,在本文第四部分中,笔者分别就完善我国现有船舶硫氧化物排放控制制度、建立船舶硫氧化物排污权交易提出了建议。
[Abstract]:Ship pollution problem has aroused widespread concern of the society. At present, the concern is not only in the crude oil, fuel oil, toxic hazardous substances pollution, but also to expand to include air pollution, many aspects including the removal of wrecks. Under this background, the international < MARPOL > issued new annex six - "rules on air pollution caused by ship to prevent the implementation of the Convention. In response, China, the United States, the European Union and other countries or regions have introduced the corresponding domestic law.2015 years, China's amendment introduced air pollution prevention law > < <, the Pearl River Delta, Yangtze River Delta, Bohai (Tianjin) waters ships emission control area plan > series of laws and regulations, in order to reduce the air pollution, the establishment of China's marine sulfur oxides has laid a solid foundation for emission control system. The control system of ship emissions in China sulfur oxides The degree of the establishment at the beginning of the academic circle's attention is confined to the shallow level, technical and operational issues, such as the domestic and foreign related laws and regulations are summarized, the ship emission control response and influence area established. As the deepening of China's marine sulfur oxide emissions control discussion, improve ship sulphur oxide emissions the control system construction, this paper from the overview of the existing system, emissions trading, suggestions to analysis of how to control the ship sulfur oxide emissions "problems in four aspects. The first part expounds the meaning of marine sulfur oxides, control system at home and abroad; the second part mainly combs the existing marine sulfur oxides the control system and its legal basis, and points out the existing problems; the third part, in order to alleviate the high cost of emission control performance and development of the shipping industry downturn in the contradiction of ship sulfur oxides, this chapter discusses The policy model two different regulation environment problems, discusses the necessity of establishing ship emission control system of emissions trading pilot area, feasibility and existing problems; finally, in the fourth part, the author will improve our existing marine sulfur oxides emissions control system, proposed the establishment of ship s oxide emissions trading.
