京津冀区域水污染协同防治法律问题研究

【摘要】:随着京津冀区域经济地位的日益凸显,也暴露出环境压力日益加剧等问题,区域内生态环境的协同治理成为京津冀协同发展战略中的重大课题,是急需率先突破的领域,而区域内水污染的协同防治亦是题中之义。近年来,京津冀区域的水污染形势相当严峻,根据环保部2016年公布的《中国环境状况公报》显示,京津冀区域内几乎无使用功能的劣Ⅴ类水质比例已经高达40%,严重的水污染不仅加剧了水资源的缺乏,水生生态系统遭到破坏,更影响了区域内正常的经济发展和人民生活。因此,京津冀三地亟待开启协同治污模式。本文主要以法律问题为视角,从京津冀区域水污染的现实状况、基本特点以及危害出发,并借鉴域外跨界水污染法律治理经验,对京津冀区域水污染协同防治的法律对策进行探索。首先,在京津冀区域协同防治水污染过程中,离不开法治的引领与保障,做到立法、执法、司法、守法的无缝对接、协同联动,才能达致京津冀区域水污染防治的目标。其次,将区域协同防治理念引入京津冀水污染防治之中,打破京津冀三地行政区划梗阻和地方性制度、观念壁垒,以实现区域水污染的协同防治。最后,本文紧紧围绕京津冀区域水污染协同防治的法律对策进行设计创新。第一,顶层专门立法。分为国家立法和地方协作立法两个层面:国家层面制定一部综合性《海河流域管理条例》;地方层面充分协作立法,进一步深化协同防治。第二,协同联动执法:主要对执法机构—海河水利委员会进行重塑革新,具体设计了组成构建和运作机制。第三,统一联合司法:加强区域司法联动协作和跨界水污染纠纷解决等机制的建立和完善。第四,保障公众参与,强调区域公众参与水污染治理的积极作用,并对公众参与的方式、方法进行阐述。
[Abstract]:With the Beijing Tianjin Hebei regional economic status has become increasingly prominent, also exposed the environmental pressure increasing, collaborative governance has become a major issue of Beijing Tianjin Hebei coordinated development strategy in the regional ecological environment, is the urgent need to lead a breakthrough in the field, while the regional water pollution prevention collaborative is also the question of meaning. In recent years, Beijing and Tianjin Hebei regional water pollution situation is quite severe, according to the Ministry of Environmental Protection announced in 2016 China environmental conditions bulletin < >, the Beijing Tianjin Hebei region almost no use of functional inferior grade V proportion has reached 40%, the serious pollution of water has not only exacerbated the lack of water resources, aquatic ecosystems have been destroyed, but the region affected in the normal economic development and people's life. Therefore, it is urgent to open the three Beijing Tianjin Hebei collaborative control mode. This paper mainly from the perspective of legal issues, from the Beijing Tianjin Hebei regional water pollution of the real situation, basic The characteristics and hazards of transboundary water pollution, and the overseas legal management experience, the Beijing Tianjin Hebei regional water pollution prevention collaborative legal countermeasures to explore. First of all, in the Beijing Tianjin Hebei regional water pollution control process, cannot do without lead and security, law enforcement, judicial, legislative do, seamless docking, law-abiding cooperation in order to achieve regional linkage, water pollution prevention and control of Beijing Tianjin Hebei. Secondly, the introduction of the concept of regional coordinated control of water pollution prevention and control of Beijing Tianjin Hebei, Beijing and Tianjin to break the three administrative divisions and obstruction of local system, the concept of barriers, to achieve coordinated control of regional water pollution. Finally, the article focuses on the Beijing Tianjin Hebei regional water pollution the legal measures for preventing the collaborative design innovation. First, the special legislation is divided into two levels. The national legislation and the local legislation collaboration: the national level to develop a comprehensive "tube in Haihe River Basin On the local level >; fully cooperative legislation, to further deepen the cooperative control. Second, collaborative linkage enforcement: the main re innovation on the Haihe River Water Conservancy Commission, law enforcement agencies, the specific design of the part in the construction and operation mechanism. Third, unified Justice: the establishment and perfection of judicial cooperation and strengthen regional transboundary water pollution dispute resolution mechanism fourth. Ensure the public participation, stressing the positive role in regional water pollution control of the public, and the public participation methods, methods are presented in this paper.
