环境保护视域下我国区域限批制度研究

【摘要】：区域限批制度于2006年开始运用在地方政府环保实践当中,2007年,原国家环保总局首次从国家层面正式启用区域限批制度,随后得到许多地方政府纷纷效仿,将该制度逐渐普及到地方环保治理领域。作为我国在环境保护领域的创新性制度安排,它的产生有着深刻复杂的背景。改革开放以来,虽然国家在经济领域实现了突破性的进展,但是我们也需注意到许多经济成就取得的背后往往是以牺牲生态环境为获取代价的,发展理念的偏差致使国家的整体生态环境问题越来越严重,先前国家采取的环境保护举措也没有达到预期的效果,这就引起政府和社会公众的高度关注和思考,区域限批制度也在这种环境中应运而生。区域限批制度作为一次有效的制度创新,在转变地方政府官员的发展理念,约束地方政府不合理的经济行为和实现区域生态环境优化等方面发挥着举足轻重的作用。虽然区域限批制度已经得到立法上的确认,并在政府环保实践中发挥着重要功能,但区域限批制度在内容和实践层面仍然存在许多缺陷,因此,急需对区域限批制度做出合理完善和改进。文章第一部分为绪论。主要介绍论文的研究背景与选题意义,论文研究主题区域限批制度的研究综述,及论文的研究方法和研究思路。第二部分为区域限批制度概述。在对区域限批制度内涵进行界定的基础上,结合目前该制度实施现状叙述了区域限批制度的构成与演进,同时对问题研究的理论基础作了阐述。第三部分重点论述区域限批制度的重要性,并对其之所以取得如此显著环保成效的独特制度优势进行了总结概括。第四部分重点分析我国区域限批制度在内容规定和实践操作过程里面存在的缺陷。第五部分文章依据第四部分的总结内容,从六个方面针对性地提出提高我国区域限批制度运行有效性的对策与建议。第六部分为结语。文章在肯定区域限批制度环保成效的同时,认为区域限批制度不应该常态化,且需在今后实践中不断完善改进。
[Abstract]:In 2006, the regional limited approval system began to be used in the practice of local government environmental protection. In 2007, the former State Environmental Protection Administration formally launched the regional limited approval system from the national level for the first time. Subsequently, many local governments followed suit, gradually popularizing the system to local environmental governance, as the innovative institutional arrangements in the field of environmental protection in China. It has a profound and complex background. Since the reform and opening up, although the country has achieved a breakthrough in the economic field. However, we also need to note that many economic achievements are often made at the expense of the ecological environment as the cost, the deviation of the concept of development makes the overall ecological environment problems of the country more and more serious. Previous national environmental protection measures have not achieved the desired results, which has caused the government and the public to pay close attention and thinking. As an effective institutional innovation, the regional limited approval system is changing the development concept of local government officials. Constraining the unreasonable economic behavior of local government and realizing the optimization of regional ecological environment play an important role, although the system of regional limited approval has been confirmed by legislation. And play an important role in the practice of government environmental protection, but there are still many defects in the content and practice of the system. The first part is the introduction. It mainly introduces the research background and the significance of the topic, and summarizes the research of the regional limited approval system. The second part is an overview of the regional limited approval system. On the basis of defining the connotation of the regional limited approval system. Combined with the current implementation of the system described the composition and evolution of the regional limited approval system, at the same time, the theoretical basis of the study is expounded. The third part focuses on the importance of the regional limited approval system. The paper summarizes the unique institutional advantages of this remarkable environmental protection effect. Part 4th focuses on the analysis of the defects of the regional limited approval system in the process of content regulation and practical operation. 5th parts. According to the 4th part of the summary content. This paper puts forward the countermeasures and suggestions to improve the effectiveness of the regional limited approval system from six aspects. Part 6th is the conclusion. The article affirms the environmental protection effectiveness of the regional limited approval system. It is suggested that the regional limited approval system should not be regularized and should be perfected and improved in practice in the future.
