多元共治理念下的环境保护公众参与制度研究

【摘要】：在社会经济和科技高速发展的今天,环境问题与日俱增,亟需转变传统的政府环境命令管制治理模式。随着社会公众的环保意识不断加强,社会公众成为环境治理工作开展的重要力量。传统的政府环境命令管制模式在中国的环境治理工作中愈显其弱势,而近年来兴起的社会治理的新理念为我国环境治理模式的创新与完善提供了方向与指导。2015年新修订的《环境保护法》中,专章规定了信息公开和公众参与,同时还建立了环境公益诉讼制度,相继出台了《关于推进环境保护公众参与的指导意见》、《环境保护公众参与办法》等一系列法律法规政策。这表明,我国已经越来越重视环境治理工作中的公众参与。本文以多元合作共治理念为视角,在强调多元化主体共同合作参与环境治理工作的前提下,分析了环境保护公众参与制度及环境多元合作共治模式的涵义、环境多元合作共治模式所涉及的主要主体,并通过对传统政府环境命令管制模式的缺陷分析,提出了引入多元化的主体参与环境治理工作的必要性及公众参与对于环境多元合作共治模式的意义。首先,概述环境保护公众参与制度及多元共治理念的相关概念,指出传统政府环境命令管制模式的不足;其次,结合相关案例对我国环境保护公众参与制度的现状进行分析,指出目前环境保护公众参与制度的绩效和在多元合作共治理念语境下存在的缺陷;最后,提出以多元合作共治为基础的环境保护公众参与制度的完善建议。
[Abstract]:With the rapid development of social economy and science and technology, environmental problems are increasing day by day. With the strengthening of public awareness of environmental protection, the public has become an important force in environmental governance. The traditional mode of government environmental order control has become more and more vulnerable in China's environmental governance work. The new concept of social governance, which has emerged in recent years, provides direction and guidance for the innovation and improvement of the environmental governance model in our country. In the newly revised Environmental Protection Law in 2015, a special chapter provides for information openness and public participation. At the same time, the system of environmental public interest litigation has been established, and a series of laws, regulations and policies have been issued successively, such as "guiding opinions on promoting Public participation in Environmental Protection", "measures for Public participation in Environmental Protection" and so on. This indicates that our country has paid more and more attention to public participation in environmental governance. From the perspective of the concept of multi-cooperative co-governance, this paper analyzes the meaning of the system of public participation in environmental protection and the mode of co-governance of environmental plural cooperation under the premise of emphasizing the cooperation of multiple subjects in environmental governance. The main subjects involved in the mode of environmental plural cooperation and co-management, and through the analysis of the defects of the traditional government environmental command control model, The necessity of introducing diversified subjects to participate in environmental governance and the significance of public participation to the mode of co-management of environmental plural cooperation are put forward. Firstly, it summarizes the related concepts of the system of public participation in environmental protection and the concept of pluralistic co-governance, and points out the shortcomings of the traditional mode of government environmental command regulation. Secondly, it analyzes the current situation of the system of public participation in environmental protection in China by combining relevant cases. The paper points out the performance of the public participation system of environmental protection and the defects in the context of the concept of multi-cooperation and co-governance. Finally, it puts forward some suggestions to improve the system of public participation in environmental protection based on multi-cooperation and co-governance.
