我国公务员聘任制度问题研究

【摘要】:20世纪80年代以来,随着新公共管理理论的兴起,西方各国开始了一场大规模的行政改革运动,在这次运动的推动下,国外公务员制度也随之不断改革并趋于完善。近年来西方国家在公务员任用方式上逐渐引入市场化竞争机制,并越来越多地采用雇员制的方式,许多公共部门以及政府机构出现了大量的合同雇用人员和临时聘用人员,不仅降低了用人成本也提高了行政效率。这种弹性化的用人方式对我国公务员制度改革有所启示,那就是公务员人事关系可以多样化,可以实行公务员聘任制。 2006年通过的《中华人民共和国公务员法》确定了公务员聘任制的法律地位,它规定了公务员聘任制的适用范围、聘任方式、管理方式以及纠纷解决机制,推动了我国政府人事管理体制的改革。近年来,我国一些地方政府也展开了对公务员聘任制的实践探索,尤其以上海浦东和深圳最为典型。在实践探索过程中,我们肯定了公务员聘任制的良性发展趋势,但同时也发现了目前存在的一系列困难和阻碍,我们在认真分析这些问题和局限性的基础上提出了一些改进措施,使公务员聘任制度能更好的适应社会经济的发展。 本文首先对公务员聘任制的研究背景和意义进行了探讨,并查阅国内外相关文献,对聘任制的研究现状和发展有了一定的认识,然后通过对相关理论和概念的论述,对这个问题有了更深层次的了解。本文着重对深圳市公务员聘任制的实践情况进行研究,主要分析了其录用方式和特点。通过研究发现,深圳市专门制定了聘任制公务员的工资分配方案以及实行了社会基本养老保险与职业年金相结合的养老保险制度,这两大特点保障了深圳市公务员聘任制的顺利实施,,同时也为以后其他地区的实践提供了一定的参考价值。但是不可否认的是,在实践研究过程中也发现了不少问题,主要表现在:一是我国对公务员聘任制定位偏低,实施范围偏小;二是正向的“鲶鱼效用”产生困难;三是公务员聘任制的运行机制尚不健全。这些问题为我国顺利实施公务员聘任制产生了阻碍。在本文的最后,我们根据存在的这些问题,提出了相应的建议措施,那就是首先要完善聘任程序,健全聘任体系;其次是重视和完善聘任制公务员社会保障制度;最后要为聘任制公务员建立起健全的绩效考核机制。 总的来说,弹性化的、灵活的用人制度是当今西方国家公务员制度改革发展的一个重要趋势,也是我国公务员制度改革的基本方向,我们在实践过程中要不断吸收借鉴西方改革的成功经验,为我国公务员制度的日趋完善铺好道路。
[Abstract]:Since 1980s, with the rise of the new public management theory, the western countries began a large-scale administrative reform movement, in the promotion of this movement, the civil servant system also will continue to reform and perfect. In recent years, the western countries in the civil service appointment mode gradually introducing market competition mechanism, and adopt more and more employees the way, many public sector and government institutions have a lot of contract to hire staff and temporary staff, not only reduces the cost by improving the administrative efficiency. This kind of flexible employment way to enlighten the reform of civil servant system, that is the civil service personnel relationship can be diversified, can implement the appointment of civil servants.
People's Republic of China civil law > < 2006 by determined the legal status of the civil service appointment system, it defines the scope of the civil service appointment appointment, management and dispute settlement mechanism, promote the reform of personnel management system of our government. In recent years, some local governments in China also started to explore the practice of the civil service appointment the system, especially in Shanghai Pudong and Shenzhen is the most typical. In the process of practice and exploration, we affirmed the benign development trend of the civil service appointment system, but also discovered a series of difficulties and obstacles existing at present, we based on analyzing these problems and the limitations of the paper puts forward some improvement measures for the civil service the appointment system can better adapt to the development of society and economy.
Firstly, the civil service appointment system research background and significance are discussed, and relevant literature at home and abroad, to have a certain understanding of the research status and the development of the appointment system, and then based on the theory and discusses the concept, have a deeper understanding of this problem. This thesis focuses on the practice of the appointment of civil servants of Shenzhen City, mainly analyzes the employment way and characteristics. Through the study found, Shenzhen specially formulated the appointment of Civil Servants Wage Distribution Scheme and the implementation of the basic social pension insurance and occupation pension Integrated pension system, these two features and ensure the smooth implementation of the Shenzhen municipal civil service appointment. At the same time for the future practice of other areas to provide a certain reference value. But it is undeniable that also found many problems in the process of practice research, the main table Now: one is China's positioning of the civil service appointment system is low, the scope is too small; two positive "catfish effect" difficulties; three is the operation of the civil service appointment mechanism is not perfect. These problems for China's implementation of the civil service appointment system has hindered. At the end of this paper, we based on the existing these problems, puts forward corresponding suggestions and measures, it is first to improve the appointment procedures, improve the employment system; second is to pay attention to the appointment of civil servants and improve the social security system; finally, to establish a sound performance appraisal mechanism for the appointment of civil servants.
In general, flexible, flexible employment system is an important trend in modern western civil service system reform and development, and is also the basic direction of China's civil service system reform, we should continue to absorb the successful experience of Western reform in practice, for the civil service system of our country is becoming more and more perfect road.
