【摘要】：我国非营利法人数量在不断增长,截止到2015年末,数量有66.2万个,增长率为9.2%,在科教文卫、社会救助、慈善事业、生态环保等方面发挥了独特的作用。非营利法人已经成为当代社会结构中不可或缺的一部分。尽管非营利法人在不断发展壮大,问题也不可避免,最突出的是资金短缺,阻碍了非营利法人的健康发展。非营利法人为解决这一问题,开始开展经营活动。非营利法人开展经营活动解决了资金短缺问题,增强了自身独立性,但是也存在一些问题。立法上对非营利法人开展经营活动界定不清、规定不足,法律与现实存在冲突。为了更好的对我国非营利法人开展经营活动进行规制,促进非营利法人持续发展,本文借鉴其他国家的先进立法和经验,结合我国非营利法人的发展现状,提出法律上的建议。立法上明确允许非营利法人开展经营活动和设定相关规则,并从内外两方面进行规制。希望本文的研究能为我国非营利法人的发展提供些许参考意义。
[Abstract]:As of end of 2015, the number of non-profit legal persons in China is growing, with a growth rate of 9.2 million, in science, education, culture and health, social assistance, philanthropy. Ecological environmental protection has played a unique role. Non-profit legal person has become an indispensable part of the contemporary social structure. The most outstanding is the shortage of funds, which hinders the healthy development of the non-profit legal person. In order to solve this problem, the non-profit legal person began to carry out business activities, and the non-profit legal person carried out business activities to solve the problem of the shortage of funds. Strengthen their own independence, but there are also some problems. Legislation on the non-profit legal person to carry out business activities is not clearly defined, inadequate provisions. There is a conflict between law and reality. In order to better regulate and promote the sustainable development of non-profit legal persons in China, this paper draws lessons from the advanced legislation and experience of other countries. Combined with the current situation of the development of the non-profit legal person in our country, this paper puts forward some legal suggestions. The legislation explicitly allows the non-profit legal person to carry out business activities and set up the relevant rules. The author hopes that the research in this paper can provide some reference significance for the development of non-profit legal person in China.
