【摘要】：帮助自杀是指对已经产生自杀想法的人给予精神或身体上的支持,主要表现为口头上的鼓励、奉劝,身体行为上的帮助表现为为其提供自杀工具。无论是哪种形式的帮助,都可以达到让自杀者更好地实施自杀行为的目的。这些行为都能够起到促进、推动、强化作用,但是帮助行为也有一定的程度限制。它和其他形式的自杀有着明显的区别。比如,帮助自杀与教唆自杀、相约自杀、胁迫自杀、欺骗自杀等等,不能混为一谈。对帮助自杀行为进行定性要准确的把握其内涵及其特征要求。而关于如何在刑法上对帮助自杀行为进行准确的定性,在刑法学界并没有形成一致的观点,有的主张按照故意杀人罪予以定罪处罚,这一观点是目前刑法学界的通说;有的认为帮助自杀并不构成故意杀人罪,反对按照故意杀人罪定罪量刑,应该予以非罪化处理。理论上虽然存在着这样的争议,但是刑事司法实践中却都是将帮助自杀按照故意杀人罪进行定罪量刑的。帮助自杀与故意杀人罪存在明显的差别,而且帮助自杀和帮助犯罪也是不同的,因为自杀不是犯罪。帮助自杀也不具备典型的犯罪特征,表现在帮助自杀不具有严重的社会危害性、不具备刑事违法性和罪责性。帮助自杀非罪化也符合刑法的内在要求,表现在帮助自杀符合刑法的目的和刑法的公正。帮助自杀行为不应成为刑法关注的对象。
[Abstract]:To help commit suicide is to give mental or physical support to a person who has already committed suicide, mainly in the form of verbal encouragement and advice. Physical behavioral help is to provide suicide tools. No matter what kind of help can achieve the purpose of better suicide behavior. These behaviors can play a role in promoting and promoting suicide. Reinforcement, but there are certain limits to helping behavior. It is distinct from other forms of suicide. There is no consistent view in the field of criminal law, some advocate according to the crime of intentional homicide to be convicted and punished, this view is the common view in the field of criminal law; Some people think that helping suicide does not constitute intentional homicide, against the conviction and sentencing according to intentional homicide, should be decriminalized. Although there is such a dispute in theory. But in the practice of criminal justice, the crime of helping suicide is convicted and sentenced according to the crime of intentional homicide. There are obvious differences between helping suicide and intentional homicide, and helping suicide and helping crime are also different. Because suicide is not a crime, helping suicide does not have typical criminal characteristics, which is manifested in the fact that helping suicide does not have serious social harm. Help suicide decriminalization also conforms to the inherent requirement of criminal law, which is manifested in that helping suicide conforms to the purpose of criminal law and the justice of criminal law. Helping suicide behavior should not become the object of criminal law.
