微信公众号转载的著作权侵权与保护研究

【摘要】:进入21世纪以来,通讯技术迅猛发展,互联网的普及与智能手机的出现开启了一个人人都是“麦克风”的自媒体时代。在这一波汹涌的自媒体浪潮中,2011年由腾讯公司开发的即时通讯类软件——微信,无疑是其中最大的赢家。其开发的微信公众号成为了继微博、博客之后的又一个更加火爆的自媒体创作平台。然而,随着用户数量的不断增长,在这一平台上也衍生出了一系列著作权侵权问题。因此,为了更好的解决这些问题,本文将对微信公众平台中侵犯著作权的主要问题——转载侵权问题进行分析、探讨,并结合我国著作权法和信息传播条例等相关法律法规,综合运用案例分析法、比较分析法、价值分析法对微信公众号的转载侵权问题进行分析论述,并对微信平台中著作权保护中存在的问题提出自己的观点和建议,以期更好的解决该问题。本文主要分为三大部分,分别为引言、正文和结论。第一部分:提出问题,阐明现今时代微信转载侵权问题日益增多、严重,应该给予充分重视和探讨;第二部分:分析问题,通过与传统媒体比较,总结微信公众号转载行为的侵权特点,并且对于微信公众号中的转载行为所侵犯的著作权进行逐个分析;接下来,鉴于其新媒体平台的独特性,结合法律规定中的合理使用制度、法定许可制度和默示许可制度对转载侵权行为是否能适用这些免责事由进行分析,从而确定这些行为应该承担怎样的侵权责任。在侵权责任承担中,责任主体主要有微信公众号的运营者(微信公众号版主)和腾讯公司,并且,腾讯公司作为网络服务提供商,其在承担责任过程中对“避风港原则”和“红旗原则”的适用也是本文探讨的重点。最后,综合前文论述与微信公众号的传播特点,本文发现,微信公众号转载侵权问题愈演愈烈与在立法中现有法律法规在保护这一新的侵权形态上的滞后性和在司法过程中举证责任分配、证据保全制度不合理、救济方式不完善等方面都有很大关联。因此,本文在文章的最后对这些问题逐一的进行了分析,并结合所学知识从立法层面和司法层面分别提出了著作权保护建议,以期更好的保护微信公众号中的著作权。第三部分即文章的结论部分,文章在这一部分总结了全文,提出了期待和展望。
[Abstract]:Since 21th century, the rapid development of communication technology, the popularity of the Internet and the emergence of smart phones opened a "microphone" self-media era. In this wave of self-media wave. WeChat, an instant messaging software developed by Tencent in 2011, was no doubt the biggest winner. Its WeChat Official account became the successor to Weibo. Blog after another more popular from the media creation platform. However, with the number of users growing, in this platform also derived a series of copyright infringement issues. In order to solve these problems better, this paper will analyze and discuss the main problem of copyright infringement in WeChat public platform-reprint infringement. And combined with the copyright law and information dissemination regulations and other related laws and regulations, comprehensive use of case analysis, comparative analysis, value analysis of WeChat Official account reprint infringement analysis. And on the WeChat platform in the copyright protection problems put forward their own views and suggestions in order to better solve this problem. This paper is divided into three parts, respectively. Text and conclusion. The first part: put forward the question, expound the current times WeChat reprint infringement problem is increasing day by day, serious, should give full attention and discuss; The second part: analyze the problem, compare with the traditional media, summarize the infringement characteristics of the reprint behavior of WeChat Official account, and analyze the copyright infringed by the reprint behavior in Official account WeChat one by one; Next, in view of the uniqueness of its new media platform, combining with the reasonable use system in the legal provisions, the legal license system and the implied license system analyze whether the reprint infringement can be applied to these reasons. In order to determine these acts should bear what kind of tort liability. In tort liability, the main body of responsibility is WeChat Official account operator (WeChat Official account moderator) and Tencent company. Tencent as an Internet service provider, its responsibility in the process of "safe haven principle" and "Red Flag principle" is also the focus of this paper. Finally. Synthesizing the previous discussion and WeChat Official account's communication characteristics, this paper found. WeChat Official account reprint tort problem intensified in the legislation of existing laws and regulations in the protection of this new form of tort lag and the distribution of the burden of proof in the judicial process, evidence preservation system is unreasonable. The way of relief is not perfect and other aspects are very relevant. Therefore, at the end of the article, this paper analyzes these problems one by one. And combined with the knowledge learned from the legislative level and judicial level respectively put forward suggestions for copyright protection in order to better protect the copyright in WeChat Official account. The third part is the conclusion of the article. In this part, the article summarizes the full text, and puts forward expectations and prospects.
