关于新中国巡回法庭制度的研究

【摘要】：我国最高人民法院巡回法庭主要包括了破除司法地方化、行政化以及优化最高人民法院职能的重要功能,故在设计最高人民法院巡回法庭这一制度时应遵循这一职能定位,本文在总结我国建国初期大区分院的相关经验的基础上,同时选择性借鉴其他法系法域关于巡回制度的成功模式,还兼顾了改革的整体性来设计最高人民法院巡回法庭这一制度。在目前最高人民法院巡回法庭制度的探索运行阶段,设置巡回法庭时综合考虑了跨区域的司法纠纷状况、案件量等因素,总之,通过设立巡回法庭制度来为司法改革和司法独立提供制度支撑,同时让司法去地方化、去行政化逐渐落到实处。本文主要从最高人民法院巡回法庭设立的历史回溯、背景、必要性与可行性、现状、国外相关经验等角度剖析巡回法庭的设立意义,并针对巡回法庭的优化提出个人建议。全文主要分为六个部分:第一部分:中国巡回制度的历史上回溯。从古至今,中国历史上不乏与当时社会发展相平衡的巡回制度,如监察御史制度的演进等。第二部分:中国巡回法庭设立的背景及原因。从经济、政治、社会等多方面的变革因素到司法体制改革,综合分析巡回法庭设立的相关背景。第三部分:当代中国巡回法庭设置的必要性与可行性。主要是结合中国国情探讨巡回法庭设立的必要性及可行性。第四部分:国外巡回制度的经验借鉴。英国巡回法庭制度及演进后的美国巡回审判模式等先进经验都为我国巡回法庭的设立提供借鉴。第五部分:最高法巡回法庭设置现状。第六部分:关于最高法巡回法庭设置理念的探讨。巡回法庭以一个全新的势头注入国家国家改革、社会变革的浪潮中,如何优化成为重点思考议题。
[Abstract]:The circuit court of the Supreme people's Court of our country mainly includes the important function of breaking the localization of the judicature, the administration and the optimization of the functions of the Supreme people's Court. Therefore, in the design of the Supreme people's Court circuit court this system should follow this functional orientation, this article summarizes the early years of the founding of China on the basis of the relevant experience of the regional branch. At the same time, the successful model of circuit system in other legal system can be used for reference selectively. It also gives consideration to the integrity of the reform to design the Supreme people's Court circuit court system. At present, the Supreme people's Court circuit court system of exploration and operation stage. When setting up the circuit court, we considered the cross-regional judicial dispute situation, the number of cases and other factors, in short, through the establishment of the circuit court system to provide system support for the judicial reform and judicial independence. At the same time let the judicial delocalization, deadministrative gradually put into practice. This article mainly from the Supreme people's Court of the establishment of the history of the circuit court backtrack, background, necessity and feasibility, the status quo. This paper analyzes the significance of the establishment of the circuit court from the perspective of the relevant experience of foreign countries. The paper is divided into six parts: the first part: the history of China's circuit system. From ancient to present. In the history of China, there are many itinerant systems balanced with the development of the society at that time, such as the evolution of the supervision system of the imperial history, etc. The second part: the background and reasons of the establishment of the Chinese circuit court, from the economic and political aspects. The reform of judicial system is the change factor of society and so on. Comprehensive analysis of the background to the establishment of the Circuit Court. Part III:. The necessity and feasibility of the establishment of the contemporary Chinese circuit courts. The main purpose is to explore the necessity and feasibility of the establishment of the circuit courts in the light of China's national conditions. Part 4th:. The advanced experience such as the British circuit court system and the evolution of the American circuit trial model all provide reference for the establishment of our country's circuit court. 5th part:. Part 6th: discussion on the idea of setting up the Supreme Circuit Court. The Circuit Court infused the national reform with a new momentum. In the tide of social change, how to optimize becomes the key thinking topic.
