网约车监管若干法律问题探讨

【摘要】:伴随移动互联网的普及,网约车已成为中国发展共享经济的最佳切入点,网约车自我国问世以来,经历了被“否定-中立-合法化”的转变历程。《管理办法》的出台,使我国成为首个在国家层面承认网约车合法化的国家,其对网约车这一业态的市场准入、经营行为、法律责任、监督检查等事项做出了指导性规定。但是网约车合法化只是起步,简单套用传统的出租车管理模式,已不适合网约车服务这一新业态的发展。各地新政陆续公布后,社会各界也争议不断,主要集中在市场准入的行政审批制、法律责任的认定、网约车保险制度等方面。本文将对网约车监管存在的若干问题进行分析探讨并提出完善建议,以期推动网约车行业健康、有序发展。本文主要分为四个部分:首先,对网约车的基本理论做简要概述,介绍网约车的起源及发展概况,总结其快速发展的原因、分析不同运营模式下涉及的法律关系;其次,指出网约车监管的必要性,概括网约车监管的发展历程及国内网约车监管现状;再次,概括我国网约车监管中存在的问题:如行政主体过度干预市场、法律责任认定不明、网约车保险制度不完善,并分析其原因;最后,在前部分对网约车分析论证的基础上,提出应采取“政府管平台、平台管车人”的监管模式,明确各方主体法律责任,完善网约车保险制度,推动网约车依法合规运营。
[Abstract]:With the popularity of the mobile Internet, car-sharing has become the best entry point for the development of shared economy in China. Since the advent of China, it has gone through the process of "negative-neutral legalization". China has become the first country to recognize the legalization of ride-sharing at the national level. Supervision and inspection and other matters have made guiding provisions. But the legalization of online ride-sharing is only a start. Simply applying the traditional taxi management mode is no longer suitable for the development of the new business of ride-sharing services. After the new policies have been announced one after another, There are also many disputes in the society, which mainly focus on the administrative examination and approval system of market access, the determination of legal liability, the insurance system of net car chartering, etc. This paper will analyze and discuss some problems existing in the supervision of net car charter and put forward some suggestions to improve it. This paper is mainly divided into four parts: firstly, the basic theory of net-ride-hailing is briefly summarized, the origin and development of net-ride-hailing are introduced, and the reasons for its rapid development are summarized. Analyze the legal relationship involved in different operation modes; secondly, point out the necessity of the regulation, summarize the development process of the regulation and the current situation of domestic regulation; third, This paper summarizes the problems existing in the regulation of net car in our country, such as excessive intervention of the administrative body in the market, the identification of the legal liability is unclear, the insurance system of the net car is not perfect, and the reasons are analyzed. Finally, on the basis of the analysis and argumentation of the first part of the article, It is suggested that the supervision mode of "government management platform, platform management person" should be adopted, the main legal responsibility of all parties should be clearly defined, the insurance system of net car charter should be perfected, and the compliance operation of network car charter should be promoted according to law.
