制度变迁视角下行政审批制度改革的困境与对策研究

【摘要】：改革开放以来,全球经济一体化进程不断加快,我国经济发展迎来了新的机遇,发展速度持续提升,市场在社会当中的地位也不断上升。行政审批制度是在我国计划经济体制的基础上建立的,迫于市场经济的发展压力,行政审批制度急需采取改革措施以避免与市场之间的冲突和矛盾,对传统经济体制条件下政府的行政职能也提出了转型要求。在市场经济体系环境中,要求政府向“服务型政府”转变,是行政审批制度改革这一转型阶段十分关键的环节,也是中国行政体制改革的重点部分。行政审批制度改革是制度变迁的一种手段,制度变迁就是为了追求利益而展开的改革行为。党的十八大工作报告中强调:“要深化行政审批制度改革,推进简政放权,转变政府职能,为公民提供健康的生活环境和有益的公共服务产品,提升社会总体福利水平。”立足于制度变迁理论,反观行政审批制度的成效,从根源上发现阻碍改革目标完成的问题,从而寻求解决问题的途径,推进行政审批制度改革工作科学高效的运行。在迎合我国特色社会主义市场经济体制实际需要的同时,规避寻租腐败风险,为行政管理相对人提供制度支持,强化政府服务意识和责任意识,矫正政府不规范行为,提升政府行政能力和办事效率。本文认识到以上现象的存在,以新一轮简政放权和行政审批制度改革为背景,首先对行政审批制度改革的背景及其研究意义做出简要阐释,在对国内外相关课题的研究现状以及研究内容和论文撰写过程中所涉及的研究方法进行了初步介绍的基础上,简单界定了行政审批制度改革有关概念并且阐述了与之相关的理论依据;然后,对我国多年来行政审批制度改革的历程以及现阶段的状况进行了全面分析,同时考量了行政审批制度改革过程中存在的困境并对其原因进行了归纳总结;再次,以美国和日本为例,对发达国家行政审批制度改革实施效果进行了分析并从中总结中对我国的启示;最后,结合前文的分析结论,从推进政府行政职能转变、完善行政许可职权审批机制、吸纳中介组织多方参与和优化行政审批监管机制等角度提出了摆脱行政审批制度改革困境的系列对策,旨在为新一轮改革进程的深化提供有益参考。
[Abstract]:Since the reform and opening up, the process of global economic integration has been speeding up, China's economic development has ushered in a new opportunity, the speed of development continues to improve, and the status of the market in the society is also rising.The administrative examination and approval system is established on the basis of the planned economic system of our country. Under the pressure of the development of the market economy, the administrative examination and approval system urgently needs to take the reform measures to avoid the conflict and contradiction with the market.Under the condition of traditional economic system, the government's administrative function is also required to be transformed.In the environment of market economy system, it is the key link of the reform of the administrative examination and approval system to change the government to "service-oriented government", and it is also the key part of the reform of China's administrative system.The reform of administrative examination and approval system is a means of institutional change.In the report of the 18th National Congress of the CPC, it was emphasized that "We should deepen the reform of the administrative examination and approval system, promote the simplification of government power, transform government functions, provide citizens with a healthy living environment and beneficial public service products, and raise the overall welfare level of society."Based on the theory of institutional change, this paper reviews the effect of the administrative examination and approval system, finds out the problem that hinders the completion of the reform goal from the root, thus seeks the way to solve the problem, and advances the scientific and efficient operation of the reform of the administrative examination and approval system.While catering to the actual needs of the socialist market economy system with Chinese characteristics, we should avoid the risk of rent-seeking corruption, provide institutional support to the administrative counterpart, strengthen the sense of service and responsibility of the government, and correct the non-standard behavior of the government.Improve the administrative ability and efficiency of the government.This article recognizes the existence of the above phenomenon, with the new round of administrative examination and approval system reform as the background, first of all, the background of the reform of the administrative examination and approval system and its research significance are briefly explained.On the basis of a preliminary introduction of the current research situation, the research contents and the research methods involved in the process of writing the thesis, the research situation of related topics at home and abroad is introduced.This paper briefly defines the relevant concepts of the reform of the administrative examination and approval system and expounds the relevant theoretical basis. Then, it makes a comprehensive analysis of the course of the reform of the administrative examination and approval system in China over the years and the current situation.At the same time, the difficulties in the reform of the administrative examination and approval system are considered and the reasons are summarized. Thirdly, taking the United States and Japan as examples,This paper analyzes the effect of the reform of the administrative examination and approval system in the developed countries and summarizes the enlightenment to our country. Finally, combining the above analysis conclusion, the author puts forward the transformation of the administrative function of the government and consummates the examination and approval mechanism of the administrative license.This paper puts forward a series of countermeasures to get rid of the dilemma of the reform of the administrative examination and approval system from the angles of absorbing the multi-party participation of the intermediary organizations and optimizing the administrative examination and approval supervision mechanism in order to provide a useful reference for the deepening of the new round of reform process.
