十八大以来中国共产党全面推进依法治国思想研究

【摘要】："法律是治国之重器,良法是善治之前提"。全面推进依法治国是我国"四个全面"战略布局的重要内容、是我国现代化建设的基本方略、是中国共产党治理能力和国家治理现代化的主要内容、是实现中华民族伟大复兴的中国梦的坚强保障。新中国建立以来,中国共产党带领全国人民进行了不懈探索,取得了丰硕成果,期间也走过一些弯路。改革开放后,特别是党的十八大以来,中国共产党在新一代领导核心习近平的带领下,锐意进取、砥砺前行,在依法治国的理念和内容上都取得了突破性的进展。论文共分为四部分,对全面推进依法治国思想进行了研究。论文的第一部分主要介绍马克思主义经典作家的法治思想,并简要介绍了十八大前我国法治的发展历程。论文的第二部分主要介绍全面推进依法治国思想的提出的背景。论文的第三部分阐述了全面推进依法治国思想的基本内容和特征,主要包括:第一,从依法管理到依法治理的转型升级。第二,从建设中国特色社会主义法律体系到构建中国特色社会主义法治体系的转型升级。第三,从有法可依到科学立法、民主立法、提高立法质量的转型升级。第四,从公正司法到严格司法、公正司法的转型升级。基本特征是全面性、创新性、协同性、人民性和公平性。论文的最后一部分阐述了中国共产党全面推进依法治国的四个着力点。
[Abstract]:The law is the important instrument of governing the country, and the good law is the premise of good governance. Promoting the rule of law in an all-round way is an important part of the "four comprehensive" strategic layout of our country, a basic strategy for the modernization of our country, and the main content of the governance ability of the Communist Party of China and the modernization of national governance. Is the realization of the great rejuvenation of the Chinese nation Chinese Dream strong guarantee. Since the founding of New China, the Communist Party of China has led the whole country in unremitting exploration and has made fruitful achievements, and has also made some detours during the period. After the reform and opening up, especially since the 18th National Congress of the CPC, under the leadership of Xi Jinping, the new generation of leading core, the Communist Party of China has made breakthrough progress in the concept and content of governing the country according to law. The paper is divided into four parts, the overall promotion of the thought of governing the country according to law has been studied. The first part of the thesis mainly introduces the Marxist classic writers' thought of ruling by law, and briefly introduces the development course of our country's rule of law before the 18th National Congress. The second part mainly introduces the background of advancing the idea of governing the country according to law. The third part of the paper expounds the basic contents and characteristics of comprehensively promoting the thought of governing the country by law, mainly including: first, the transformation and upgrading from the management by law to the administration by law. Second, from the construction of socialist legal system with Chinese characteristics to the construction of socialist legal system with Chinese characteristics. Third, from the law to scientific legislation, democratic legislation, improve the quality of the transformation of legislation. Fourth, from just justice to strict justice, just judicial transformation and upgrading. The basic features are comprehensiveness, innovation, synergy, people and fairness. The last part of the paper expounds the four key points of the Communist Party of China to advance the rule of law in an all-round way.
