评价理论视角下法律学术论文引言的人际意义研究

【摘要】:随着国际交流的日益增多,专门用途英语受到前所未有的重视。法律英语作为一种特殊的专门用途英语,近十几年来也越来越多地受到国内高校法律专业的重视。同时,国内外已有不少学者从多方面对法律英语进行了研究,但是几乎无人涉及法律英语的学术论文。并且,,在学术论文中,引言又是一个比较特别的语篇,有其独特的特征,目前关于引言的研究主要集中在体裁分析和特殊的词汇上,很少有人关注它的人际意义。而Martin的评价理论是支撑人际意义的重要理论之一,考虑到引言的特征,本文将利用Martin评价理论(2005)中的介入资源来分析法律学术论文引言的人际意义。 鉴于此,本文将对法律学术论文引言的人际意义进行分析,本文的语料均来自五个国际上比较权威的法律期刊:Harvard International Law Journal, The YaleJournal of International Law, Michigan Law Review, University of Pennsylvania LawReview, Stanford Law Review.从每个期刊上随机抽取24篇文章,共计120篇,再把这120篇文章的引言建立一个小型的语料库,共计135697个字。然后,根据介入资源的组成部分,对所搜集的语料进行标注,并运用Wordsmith软件提取标注,最后,结合引言特征和所获得数据,对引言的人际意义进行分析和研究。 通过对所搜集的语料的分析,作者对法律学术论文的引言有得出以下结论:多声资源要远远多于单声资源;在多声中,对话紧缩多于对话扩张,但差别并不大;对话扩张中的容纳资源(entertain)和对话紧缩中的拒称资源(disclaim)在多声中占相当大的比重,位居前两位;而对话扩张中的归源(attribute)和对话紧缩中的宣称资源(proclaim)在多声中所占的分量很小。从以上结论可以看出,在法律学术论文的引言中,作者倾向使用多声资源中的容纳(entertain)和拒称(disclaim)。一方面,作者是为了尊重读者,允许对同一命题的评价有不同的观点;另一方面,作者在尊重前人观点的同时,还要坚定地表明自己的立场。 本研究不仅扩展了评价理论研究的范围,而且还有助于法律学习者理解在法律学术论文的引言中人际意义是如何实现的,有益于他们更好地阅读国外的法律文献。并且,对他们写出高质量的引言有一定的借鉴意义,以便在国际权威的法律期刊上发表文章。
[Abstract]:With the increasing number of international exchanges, ESP has received unprecedented attention. Law English as a special ESP. In the past ten years, more and more attention has been paid to legal English in colleges and universities at home and abroad. At the same time, many scholars at home and abroad have studied legal English from many aspects. But there are few academic papers on legal English. Moreover, in the academic papers, the introduction is a relatively special text, with its unique characteristics. At present, the research on preface mainly focuses on genre analysis and special vocabulary, and few people pay attention to its interpersonal meaning. Martin's evaluation theory is one of the important theories supporting interpersonal meaning. Considering the characteristics of the introduction, this paper will analyze the interpersonal meaning of the introduction of the legal academic paper by using the intervention resources in the Martin evaluation theory / 2005). In view of this, this paper will analyze the interpersonal significance of the introduction of the legal academic paper. The corpus of this paper is drawn from five international authoritative legal journals:: Harvard International Law Journal. The YaleJournal of International Law, Michigan Law Review. University of Pennsylvania LawReview. Stanford Law Review. Random sampling of 24 articles from each journal, a total of 120, and the introduction of these 120 articles to create a small corpus. A total of 135697 words. Then, according to the components of the intervention resources, the collected corpus is annotated, and the Wordsmith software is used to extract the annotations. Finally. This paper analyzes and studies the interpersonal meaning of the preface based on the preface features and the data obtained. Based on the analysis of the collected corpus, the author draws the following conclusions from the introduction of the legal academic papers: Multi-sound resources are far more than monophonic resources; In the multi-tone, the dialogue contraction is more than the dialogue expansion, but the difference is not big; The holding resources in dialogue expansion) and the disclaimer in dialogue contraction account for a large proportion in the multitone, ranking the first two; The attribution in the expansion of dialogue and the claim of resources in the contraction of the dialogue account for very little in the multitone, as can be seen from the above conclusions. In the introduction to a legal academic paper, the author tends to use the multitone resource to accommodate the disclaimer. On the one hand, the author aims to respect the reader. Allow for different views on the evaluation of the same proposition; On the other hand, while respecting the views of the predecessors, the author must firmly state his position. This study not only expands the scope of evaluation theory, but also helps law learners understand how interpersonal meaning is realized in the introduction of legal academic papers. It is beneficial for them to read the foreign legal documents better, and it is useful for them to write high-quality prefaces, so as to publish articles in international authoritative law journals.
