动漫角色商品化权法律保护模式研究

【摘要】：随着市场经济的高度发展,动漫角色已经由艺术领域商品化到经济领域,其自身的潜在经济价值得到充分的开发。随之而来的是动漫角色商品化背后的利益保护问题。虽然我国对动漫角色采用了知识产权法综合保护的模式,但是仍存在着不足,有必要根据我国的具体情况探讨出一套适合的法律保护模式。本文主要运用了系统研究和比较研究的方法,从动漫角色商品化现象出发,在探求角色商品化现象的历史沿革、发展现状和发展方向的基础上,阐述了当前动漫角色商品化权保护的严峻形式及必要性。在法哲学的基础上探讨动漫角色商品化权的价值基础、权利界定、权利性质和法律关系。基本的理论探讨后,本文从著作权法、商标法、反不正当竞争法等各个角度考察了美、日、德三国关于动漫角色商品化保护制度的立法例和司法实践,为我国的法律保护模式的建立提供有用的参考。通过对我国著作权法、商标法和反不正当竞争法的优势和不足两方面的分析,找出我国法律保护的问题所在。深入探讨动漫角色背后的影响力和对动漫角色进行的二次商业开发两方面所体现的动漫角色商品化的实质,分析我国不适宜采用单独立法模式保护动漫角色商品化权的原因。最后,借鉴动漫大国的成功经验,笔者认为我国更适合采用著作权法、商标法和反不正当竞争法综合保护的模式,并且从立法、司法、行政执法和市场经营各层次对我国动漫角色商品化权的保护提出建议,以构建我国对动漫角色商品化权的综合保护模式。
[Abstract]:With the highly development of market economy, animation characters have been commercialized from art to economy. Its potential economic value has been fully developed, followed by the protection of interests behind the commercialization of animation characters. Although our country has adopted the comprehensive protection model of intellectual property law for animation characters, there are still some shortcomings. It is necessary to explore a suitable legal protection model according to the specific situation of our country. This article mainly uses the systematic research and the comparative research method, embarks from the animation character commercialization phenomenon, in the exploration role commercialization phenomenon historical evolution, the development present situation and the development direction foundation, This paper expounds the severe form and necessity of the protection of the commercialization right of animation characters at present. On the basis of legal philosophy, it discusses the value basis, the definition of rights, the nature of rights and the legal relationship. From the aspects of copyright law, trademark law, anti-unfair competition law and so on, this paper examines the legislation and judicial practice of the commercialization protection system of animation characters in the United States, Japan and Germany. It provides a useful reference for the establishment of legal protection model in China. Through the analysis of the advantages and disadvantages of China's copyright Law, Trademark Law and Anti-unfair Competition Law, Find out the problem of legal protection in our country. Deeply discuss the influence behind the animation characters and the essence of the commercialization of the animation characters embodied in the second commercial development of the animation characters. This paper analyzes the reasons why it is not appropriate for China to adopt a separate legislative model to protect the commercialization right of animation characters. Finally, the author thinks that the copyright law is more suitable for China to use for reference the successful experience of the big country of animation and animation. The comprehensive protection model of trademark law and anti-unfair competition law, and the suggestions on the protection of commoditising right of animation characters in China from the aspects of legislation, judicature, administrative law enforcement and market operation are put forward. In order to construct our country to the commoditization right of animation character comprehensive protection model.
