中国古代应用律学与理论律学的分镳

【摘要】：本文从学科理论的层面,构建了中国古代"应用律学"与"理论律学"的基本概念,并从中国古代律学史上客观存在的"应用律学"与"理论律学"的历史勾勒入手,以对当代关论域理论研究成果的分析为参照,探寻我国律学研究中"应用律学"与"理论律学"分野的历史走向,旨在"厘清分野,追寻沿革,探求规律,凝练理论"。
[Abstract]:This paper constructs the basic concepts of "applied law" and "theoretical law" in ancient China from the aspect of discipline theory, and begins with the historical outline of "applied law" and "theoretical law" that exist objectively in the history of ancient Chinese law. Based on the analysis of the research results of the contemporary Guan theory, this paper explores the historical trend of the division between the applied law and the theoretical law in the study of law in China, aiming at "clarifying the distinction, pursuing the evolution, seeking for the law, and condensing the theory".
