同心装饰公司优先购买权案的案例分析

【摘要】:伴随房屋租赁市场的逐步发展以及流动人口的加剧,房屋转租现象也越来越普遍。在房屋租赁关系中,次承租人权利的保护显得比较薄弱,而次承租人是租赁房屋的实际占有、使用人,利益最容易受到侵害。在司法实务中,次承租人要求行使优先购买权的案件屡有发生,但是法律对次承租优先购买权以及行使条件等问题没有具体的规定,因此在案件处理上也有所差异。本文结合同心装饰公司起诉行使优先购买权一案,对次承租人优先购买权的相关问题进行分析阐述,希望能对正确处理这类案件有所帮助。 本文的结构如下:第一章简要介绍同心公司优先购买权案的基本案情,并通过对案情的分析归纳出案件存在的两个争议焦点,即同心装饰公司是否是合法承租人以及其是否享有房屋优先购买权这两个争议焦点;第二章对第一章所归纳的争议焦点进行法理分析,首先通过对涉案当事人之间的法律关系进行梳理分析,结合相关法律条文以及法学理论,得出同心装饰公司是合法承租人的结论,其次是从优先购买权制度的价值来论证次承租人享有优先购买权的合理性;第三章主要探讨在司法实务中处理次承租人优先购买权纠纷容易遇到的一些问题,这一章所涉及到的问题主要是次承租人优先购买权所具有-些特殊问题,即在通知义务、优先购买权竞合等方面与承租人优先购买权所不同之处。
[Abstract]:With the gradual development of housing rental market and the aggravation of floating population, the phenomenon of house sublease is becoming more and more common. The protection of the sub-lessee 's rights is weak in the rental relationship, but the sub-lessee is the real occupant of the leased house, the user is the most vulnerable to infringement. In judicial practice, there are many cases in which the sub-lessee requests to exercise the preemption right, but the law has no specific provisions on the sub-tenancy preemption right and the exercise conditions, so there are some differences in the handling of cases. Combined with the case of concentric decoration company suing the exercise of preemption right, this paper analyzes and expounds the relative problems of sub-lessee 's preemptive right, hoping that it will be helpful to deal with this kind of cases correctly. The structure of this paper is as follows: the first chapter briefly introduces the basic facts of the case, and through the analysis of the case, concludes the two controversial focus of the case. That is, whether the concentric decoration company is a legal lessee and whether it enjoys the preemptive right to purchase the house. The second chapter makes a legal analysis of the dispute focus summarized in the first chapter. First of all, through the analysis of the legal relationship between the parties involved, combined with the relevant legal provisions and legal theory, we can draw the conclusion that the concentric decoration company is the legal lessee. Secondly, it proves the rationality of the sub-lessee to enjoy the preemptive right from the value of the preemptive right system. The third chapter mainly discusses some problems that are easy to encounter in dealing with the sub-lessee 's preemptive right dispute in the judicial practice. This chapter mainly deals with the sub-lessee 's preemptive right, which is different from the lessee's preemptive right in the aspects of notification obligation, preemptive right competition and so on.
