中国法律法规中的模糊词语及其英译研究

【摘要】:随着中国与世界各国交流的日益频繁,完善我国的法律法规对于我国进一步扩大国际交流起着重大的作用。同时,为了使其他国家更好地了解我国的各项法规,对国内法律的高质翻译显得尤为重要。 立法语言和法律翻译以准确为原则,而模糊性是立法语言的客观属性之一,因此立法语言作为精确与模糊的矛盾体必然给法律工作者和法律翻译者带来不少困难。近年来,越来越多的中西方语言学家致力于研究立法语言的模糊性,但很少有人以中国法律法规为素材对模糊词语的运用和英译方法进行具体分析。因此作者选择这一课题,以期能够帮助读者更好地理解立法语言中的模糊性,同时为我国法律翻译工作者提供处理模糊词语的建议和方法。 本文在前人的研究基础之上,试图解决以下三个研究问题:1.在以准确为原则的立法语言中,模糊词语为何会存在?2.立法语言中的模糊词语,从词性的角度分析,主要有哪些比较常见的类型?3.在翻译中国法律法规中的模糊词语时,以对等翻译理论和功能翻译理论为指导,可以总结出哪些有效的翻译方法? 本文的语料主要来源于作者收集的12部中国法律法规及其英文译本。作者运用大量语言数据从理论和实践两方面对立法语言中的模糊词语做了比较清晰的阐述,得出以下结论:1.模糊词语客观地存在于立法语言中,其存在有其合理原因。事实上,立法语言中的模糊词语不仅没有削弱法律的精确性,反而是对其的补充。2.在立法语言中,模糊性主要体现在名词意义的边界模糊、动词意义的边界模糊、形容词意义的边界模糊、副词意义的边界模糊。3.在大量实例分析的基础上,以对等翻译理论和功能翻译理论为指导,总结出四种英译方法:模糊对等翻译法、灵活转化法、适当增词法、合理删减法。同时作者认为,法律翻译中的译者有发挥主观能动性和创造性的空间,但是发挥主观能动性时需忠实于原文谨慎地翻译。
[Abstract]:With the increasing frequency of exchanges between China and other countries in the world, the improvement of China's laws and regulations plays an important role in the further expansion of international exchanges. At the same time, in order to make other countries better understand the laws and regulations of our country, it is particularly important for the high quality translation of domestic laws. Legislative language and legal translation are based on the principle of accuracy, and fuzziness is one of the objective attributes of legislative language. Therefore, legislative language, as an accurate and vague contradiction, will inevitably bring many difficulties to legal workers and legal translators. In recent years, more and more Chinese and western linguists have devoted themselves to the study of the fuzziness of legislative language, but few people use Chinese laws and regulations as the material to analyze the use of fuzzy words and English translation methods. Therefore, the author chooses this topic in order to help readers better understand the fuzziness in legislative language, and at the same time to provide suggestions and methods for Chinese legal translators to deal with vague words. On the basis of previous studies, this paper attempts to solve the following three research problems: 1. In the legislative language based on the principle of accuracy, why do vague words exist? 2. What are the main common types of vague words in legislative language from the point of view of part of speech? 3. What effective translation methods can be summed up under the guidance of equivalence translation theory and functional translation theory when translating vague words in Chinese laws and regulations? The corpus of this paper mainly comes from 12 Chinese laws and regulations collected by the author and their English translations. The author makes a clear exposition of the fuzzy words in the legislative language from both theoretical and practical aspects by using a large number of language data, and draws the following conclusions: 1. Fuzzy words exist objectively in legislative language, and there are reasonable reasons for their existence. In fact, vague words in the legislative language not only do not weaken the accuracy of the law, but complement it. 2. In legislative language, fuzziness is mainly reflected in the boundary ambiguity of noun meaning, verb meaning, adjective meaning and adverb meaning. On the basis of a large number of examples, under the guidance of equivalence translation theory and functional translation theory, four kinds of English translation methods are summarized: fuzzy equivalence translation method, flexible transformation method, appropriate word addition method and reasonable deletion method. At the same time, the author believes that translators in legal translation have room for subjective initiative and creativity, but should be faithful to the original translation when giving full play to subjective initiative.
