The Standardization and Artistry of Language in Chinese Crim

　　随着我国社会主义法治文明的不断完善,人们学习法律、利用法律维护自身合法权益的意识不断增强。根据中华人民共和国法律规定,辩护制度是刑事法律中的一项重要的诉讼制度,而刑事辩护词则是被告维护自身合法权益,实现辩护职能最重要的工具之一。法律与语言的关系密不可分,对刑事辩护词语言特征的研究,对实现辩护词的劝说目的有着非常重要的作用。虽然国内外对辩护词的研究已经取得了许多显著的成就,但很少或几乎没人从目的原则角度对辩护词进行法律语言特征的分析。 目的原则是中国语言学家廖美珍教授于2002年在中国首次系统提出的一种新的语用原则。本文通过对10个精心选取的刑事辩护词片段的书面语言从目的原则角度展开研究,旨在探索中国刑事辩护词中语言艺术性的适用性及其表现,以及如何平衡语言规范性和艺术性之间的关系。经过全面深入的分析,本文得出以下结论:第一,语言艺术性,即个性化,通俗易懂,模糊,情感诉求,生动,在中国刑事辩护词中是普遍适用的;第二,语言规范性和语言艺术性在中国刑事辩护词中是可以平衡的,其中语言的规范性是辩护词的主要特点,语言的艺术性是辩护语言的次要手段。 此外,由于时间和篇幅的限制,本文还...
