从功能对等的角度探讨法律术语的翻译原则及方法

　　随着全球化进一步深入,中国进一步推进改革开放,各个领域的国际交流也随着增多。在处理诸多国际事务中,法律交流作用也越来越突出。然而各国之间的法律交流离不开法律翻译。近几年来,我国对法律翻译的需求量越来越大。法律翻译方面的研究也受到了学者们的重视。其中,法律术语是法律翻译研究一个重要课题。法律术语翻译直接影响着法律翻译的质量。 法律术语是法律语言的核心词汇,是对法律现象及事物的高度概括。法律术语也是法律翻译者面临的挑战和难点之一。在具体的法律翻译实践中,法律术语翻译还是存在一些问题,比如法律术语的误译、法律术语不一致现象。针对这些问题,本文从功能翻译理论出发,结合法律术语自身的特点,采用了概念分析法,提出了相应的翻译原则与方法。 本文的主要内容可以从以下三个方面来阐述。首先,本文从词源、语义及语体方面分析了法律术语的特点。这对法律术语翻译的可接受性有一定的指导意义。其次,在了解其特点的基础,本文介绍了奈达的功能对等理论,以及Sarcevic的法律翻译观点,阐述了功能对等理论在指导法律术语翻译中的合适性及意义。最后,基于本文的翻译理论框架,提出了三大翻译原则,即法律功能对等原则、语义对等原则...
