法庭会话的语境分析

　　目前中国的立法现状及法庭参与者的地位,基本是通过法庭审判体现的,而法庭会话作为法庭审判的主要载体,应当受到更多的关注和研究。然而目前在国内,注重这一方面研究的学者并不多见,比较有成就的是廖美珍教授,但其研究成果多为对问话行为的分布进行数据统计分析。那么如果以上下文语境以及认知语境的角度研究,是否会有不同的结论呢?带着这些疑问,本文作者展开了下面的研究。本文研究的目的在于结合语境理论,着重从语言学的角度分析中国法庭审判,研究和发现法庭对话体现的参与者的作用和地位、以及诉讼策略等,旨在指出中国法庭审判中存在的一些问题、提出建议,并促进语言学家和法律专家的合作以改善目前的法庭回话语言状况。纵观语境理论的发展历程,主要分类两个阶段,静态语境和认知语境研究阶段。所以本文首先用静态语境的相关理论来分析法庭会话,具体内容包括国内外关于静态语境研究的理论和用静态语境理论来分析法庭会话,并且通过比较用静态语境理论分析的优劣而得出结论。接下来是从认知语境的角度分析法庭会话。鉴于认知语境的特点,有必要确定一个范围进行研究和分析,通过研究发现利用认知语境模型分析比较可行。本章由认知语境的相关理论引出模型的内容...
