媒体对用户贡献内容(UGC)的使用规范研究

【摘要】:随着新媒体和移动终端的发展,用户贡献内容全面渗入到各种媒体当中,已成为媒体信源的重要组成部分。媒体对用户贡献内容的使用主要有四种形式:第一是整合使用用户内容;第二是借助用户制作平台推广节目;第三是与用户协同参与新闻报道;第四是为新闻传播提供新的服务功能。由于现行相关法规与行业规范的不足以及媒体在市场主义与专业主义的博弈中迷误,媒体在使用用户贡献内容时频频出现伦理失范或争议事件。文章结合上海踩踏事件、李光耀死讯事件、上海地铁9号线“咸猪手”事件以及北京老人撞人事件等具体案例,分析了媒体在使用用户贡献内容中出现的几类伦理问题:侵犯隐私权利、助推网络谣言、助燃网络情绪、催生逆转新闻。同时还对用户贡献内容的主要使用规范进行了梳理,包括现行法律规范和行业内部约束。文章从信息合理使用规范的争议、公共利益的界定模糊、法律法规过于笼统、自律体系尚不健全、市场主义与专业主义的博弈等方面,分析了媒体使用用户贡献内容时仍需解决的难点。在此基础上,文章尝试提出以下建议。首先,规范用户贡献内容的获取行为:不同媒介区别对待、规范条例具体化。其次,完善用户贡献内容核实机制:建立信息确认关系网、开发信息核实工具、设置独立的隐私权监管机构、第三方协助媒体过滤用户贡献内容。最后,区分用户贡献内容的使用范围与方式:明确公共利益的范围、适当调整报道重心。从长远来看,用户贡献内容在新闻信息源中会占据越来越大的比重。因此,对于媒体在使用用户贡献内容过程中所出现的伦理问题,媒体需要提高自律意识,各级主管部门需要充分发挥他律作用。在严格遵守当前使用规范的前提下,针对尚未解决的难点问题,加强自律和他律,为创造一个更好的新闻传播环境而努力。
[Abstract]:With the development of new media and mobile terminals, user contribution content has penetrated into all kinds of media, and has become an important part of media sources. There are four main forms in which the media contribute to the content of the user: the first is to integrate the user's content; the second is to promote the program with the help of the user's production platform; the third is to participate in the news report in cooperation with the user; The fourth is to provide new service function for news communication. Due to the deficiency of current relevant laws and regulations and the media's misunderstandings in the game between marketism and professionalism, the media frequently appear ethical anomie or controversy when they use the content contributed by users. The article combines the Shanghai stampede, the death of Li Guangyao, the "salty Pig hand" incident on Shanghai Metro Line 9 and the incident of the old man in Beijing, and so on. This paper analyzes several kinds of ethical problems that appear in the use of user's contribution content in the media: violating privacy rights, promoting network rumors, fuelling network emotions and promoting reverse news. At the same time, the main usage norms of user contribution content are combed, including current legal norms and industry internal constraints. In this paper, we discuss the dispute of the standard of rational use of information, the definition of public interest is vague, the laws and regulations are too general, the system of self-discipline is not perfect, the game between marketism and professionalism, and so on. This paper analyzes the difficulties that still need to be solved when media use users to contribute content. On this basis, the article tries to put forward the following suggestions. First of all, regulate the user contribution content access behavior: different media treatment, specification regulations specific. Secondly, improve the mechanism of user contribution content verification: establish the information confirmation relationship network, develop information verification tools, set up independent privacy regulatory agency, third party assist media filter user contribution content. Finally, to distinguish the use of user contribution content and ways: clear the scope of public interest, adjust the focus of the report. In the long run, user contribution content will occupy more and more proportion in news information source. Therefore, the media need to raise the awareness of self-discipline and give full play to the role of heteronomy in the process of using users to contribute content. Under the premise of strictly observing the current usage norms, we should strengthen self-discipline and heteronomy in order to create a better news communication environment in view of the difficult problems that have not yet been solved.
