【摘要】：在侵犯财产类犯罪中抢劫既侵害公民的财产权，又侵害其人身权，被害人在遭遇抢劫后很长一段时间都处在被抢的恐惧中难以恢复平静，心理阴影一直挥之不去，给其造成巨大伤害。在我国关于抢劫罪的理论研究比较多，对于此罪在某地的区域特征以及预防抢劫犯罪的方法等则较少触及。因此通过了解抢劫犯罪的犯罪主体、犯罪对象以及行为方式等对该罪进行分析研究，探讨抢劫行为人的犯罪心理、诱发犯罪的原因以及如何预防抢劫的发生，从而帮助社会公众消除对抢劫罪的恐惧是一项极其重要的工作。本文选取的H市是一个经济发达，物质丰富的繁荣地带，随处可见的工厂，促进了H市工业的快速发展，本地居民与大量外来务工人员的混杂使得抢劫在该市频发，为了解抢劫罪在该地区的现状本文选取H市近五年提请批捕的刑事案件数据作为研究H市抢劫犯罪的样本。首先介绍H市的基本情况，通过概括H市抢劫犯罪的总体情形，从抢劫罪的犯罪主体、犯罪对象以及行为方式入手，通过对近五年的数据分析，，总结出该市抢劫犯罪的特征，其中以色诱抢劫将行为对象由女性向男性转移、传统蒙面抢劫等方法呈下降趋势、匕首成为犯罪人携带凶器抢劫的首选工具、麻醉抢劫常成为抢劫大案的作案手段等为突出特点。在此基础上试图从行为人方面、被害人方面以及社会环境方面，对H市抢劫犯罪的主要影响因素进行分析：一是无业成为实施抢劫犯罪的直接原因，犯罪成本低是抢劫犯罪高发的又一原因；二是防范意识淡薄给犯罪分子提供了作案的机会，抵制犯罪观念弱助长了犯罪分子的嚣张气焰；三是药品监管与车辆管理的不到位，吸毒与赌博等不良社会风气的盛行都成为诱发抢劫犯罪的因素。对此，本文为有效预防H市抢劫犯罪的发生提出几点建议：首先，增加就业与再就业机会从根本上解决经济来源问题，加大刑罚处罚力度让犯罪分子望而生畏；其次，加强法制宣传、进行安全教育，在强化防范意识的同时提升抵制犯罪的观念；最后，完善对麻醉药品与车辆的管理制度，对娱乐场所和出租屋进行专项整治。
[Abstract]:In the crime of infringing on property, robbery not only infringes the property rights of citizens, but also infringes on their personal rights. After being robbed for a long time, it is difficult for the victims to restore calm in the fear of being robbed, and the psychological shadow has been lingering. In our country, there are more theoretical studies on robbery, but less touch on the regional characteristics of the crime in a certain place and methods of preventing robbery. Therefore, by understanding the subject of robbery, The object and behavior of the crime are analyzed and studied to explore the criminal psychology of the perpetrator of robbery, the causes of inducing the crime and how to prevent the occurrence of robbery. Thus, it is an extremely important task to help the public eliminate the fear of robbery. City H, selected in this paper, is a prosperous region with a developed economy and abundant material resources, with factories everywhere, and it has promoted the rapid development of industry in H City. The mix of local residents and a large number of migrant workers has led to frequent looting in the city. In order to understand the present situation of robbery in this area, this paper selects the data of criminal cases submitted for approval in the past five years in H City as a sample to study robbery crime in H City. Firstly, the basic situation of H City is introduced, and the general situation of robbery crime in H City is summarized. Starting from the subject of robbery, the object of crime and the way of behavior, through the analysis of the data in the past five years, the characteristics of the crime of robbery in this city are summarized, in which the object of behavior is transferred from female to male by seducing robbery. The traditional methods such as masked robbery show a downward trend, dagger becomes the first choice tool for criminals to carry murder weapon, and narcotic robbery is often used as a criminal means of robbery. In the aspect of victims and social environment, the main influencing factors of robbery crime in H city are analyzed: first, unemployment becomes the direct cause of robbery crime, and the low cost of crime is another reason for the high incidence of robbery crime; Second, the weak awareness of prevention provides criminals with the opportunity to commit crimes, and resisting the weak concept of crime contributes to the arrogance of criminals; third, drug supervision and vehicle management are not in place. The prevalence of bad social atmosphere, such as drug abuse and gambling, all become the factors inducing robbery crime. In view of this, this paper puts forward some suggestions for effectively preventing robbery crime in H City: first of all, To increase employment and re-employment opportunities to fundamentally solve the problem of economic resources, increase the intensity of punishment so that criminals fear; secondly, strengthen legal publicity, carry out safety education, At the same time, we should strengthen the consciousness of prevention and raise the concept of resisting crime. Finally, we should perfect the management system of narcotic drugs and vehicles, and carry out special renovation on entertainment places and rental houses.
