韩非交易机制的新制度主义解读——以秦亡为切入点

【摘要】：秦二世而亡的问题可以转化为韩非的交易制度为何在大一统前有效而在大一统后无效的问题。韩非的交易机制以"上制好恶"和"抱法处势"为基础,由利出耕战、推功称能、叁伍参验组成。在秦大一统前,该机制既能满足君主一统天下的富强之业,又能满足臣民的富贵之业,是相对均衡的制度;在秦大一统后,政治环境的根本性变化导致该机制实质上失正,具体表现为"抱法处势"失灵、耕战制度失时、重赏重罚失衡,最终演变成为君主对臣民的彻底剥削。当秦国制度没有因应时代变化做出调整、君民利益失衡时,秦国政权就快速灭亡了。
[Abstract]:The problem of Qin II's death can be transformed into the issue of why the trading system of Han Fei was effective before unification and ineffective after unification. The trading mechanism of Han Fei is based on "the superior system likes and dislikes" and "holding the law and dealing with the situation". Before the unification of Qin Dynasty, this mechanism could not only satisfy the prosperity and power of the monarch, but also meet the prosperity and power of the subjects, and it was a relatively balanced system. After the unification of Qin, the fundamental change of the political environment led to the substantial loss of the mechanism. When the system of farming and war is lost, the heavy rewards and heavy penalties are out of balance, and finally the monarch completely exploits his subjects. When the Qin regime did not adjust to the changes of the times and the interests of the monarch and the people were out of balance, the Qin regime quickly perished.
