【摘要】：马克思主义法治观,是马克思主义法学思想体系的重要内容之一,涵盖了马克思主义经典的法治观以及有中国特色的社会主义法治观。在社会主义法治建设的进程中,我国结合自身实际,在马克思、恩格斯法治观与列宁法治观的基础上,不断推动马克思主义法治观的中国化。法治中国建设是我国改革开放新时期背景下对社会主义法治建设的高度概括与深化,这既是社会主义政治文明建设的内在规定,也是社会主义市场经济发展的强力保证。法治中国建设的推进与最终实现既需要马克思主义法治观作为其理论基础,又需要具备一定的经济条件、政治条件与思想条件。改革开放以来,法治中国建设取得了一定的成就,但仍存在着诸多阻碍因素。探究以马克思主义法治观为指导的法治中国建设的现实路径是研究的着重点。第一,全面推进依法治国,完善中国特色社会主义法治观。科学地坚持和发展马克思主义法治观;坚持社会主义法治建设“三统一”原则;坚持依法治国与以德治国的互补与统一。第二,全面推进法治“三位一体”建设,建设法治国家、法治政府、法治社会。健全和完善中国特色社会主义法律体系,树立宪法的至上权威;着力加强法治政府建设,推进依法行政;确保和维护司法公正,重塑司法的公信力;积极推动法治社会建设,培育公民的法治意识与观念。从依法执政、科学立法、严格执法、公正司法、全民守法等方面共同努力,是推进法治中国建设的合理路径。
[Abstract]:Marxist view of rule of law is one of the important contents of Marxist legal thought system. It covers the classic Marxist view of the rule of law and the socialist view of the rule of law with Chinese characteristics. In the process of the construction of socialist rule of law, our country combines its own reality in Marx. On the basis of Engels' view of rule of law and Lenin's view of rule of law. The construction of China under the rule of law is a high generalization and deepening of the construction of socialist rule of law in the new era of reform and opening up in China. This is not only the internal regulation of the construction of socialist political civilization, but also the strong guarantee of the development of socialist market economy. We also need to have certain economic conditions, political conditions and ideological conditions. Since the reform and opening up, the rule of law in China has made certain achievements. However, there are still many obstacles. It is the focus of the study to explore the realistic path of the construction of China under the guidance of Marxist view of the rule of law. First, to comprehensively promote the rule of law. To perfect the concept of the rule of law of socialism with Chinese characteristics, and to adhere to and develop the Marxist view of the rule of law scientifically; Adhere to the principle of "three unity" in the construction of socialist rule of law; Second, we should promote the construction of "trinity" of the rule of law in an all-round way, and build a country ruled by law and a government ruled by law. Perfect and perfect the legal system of socialism with Chinese characteristics and establish the supreme authority of the constitution; Strengthen the construction of the government ruled by law and promote the administration by law; To ensure and maintain judicial justice and rebuild the credibility of the judiciary; We should actively promote the construction of a society ruled by law, cultivate citizens' awareness and concept of the rule of law, and make joint efforts in such aspects as ruling by law, scientific legislation, strict law enforcement, just administration of justice, and law-abiding by the whole people. It is a reasonable way to promote the construction of China under the rule of law.
