全面依法治国背景下社区治理法治化研究

【摘要】：党的十八届四中全会通过的《中共中央关于全面推进依法治国若干重大问题的决定》指出,全面推进依法治国,基础在基层,工作重点在基层。作为社会有机体最基本的单元,社区在自身的发展过程中,需要不断进行社区治理法治化的探索和实践:树立法治思维,培育法治意识,坚持良法之治,坚持依法而治,不断增强居民法治观念,营造社区法治氛围,建构社区治理良序,强化法治程序规则,创新社区治理模式,解决社区共同问题,全面推进依法治社各项工作扎实展开,更好地促进社区经济、社会、文化的发展,提高社区居民生活水平和推动社区治理模式创新。论文以社会主义法治理念为视角,采用文献资料法、比较分析法,研究全面依法治国背景下社区治理法治化问题。论文在厘清社区治理法治化和全面依法治国等基本概念及其相互联系的基础上,对社区治理法治化的现状、问题和原因进行了全面分析,针对现阶段我国社区治理工作普遍存在的社区党组织依法执政能力不足、自治组织角色变化不适、营利组织法制监管缺失、社会组织专业服务失范和社居民法治参与不够等五大问题,深入查找了传统社区"人治"思想难消除、社区治理政策法规不完善、社区成员角色转变不适应、社区治理资源投入不充分等主客观原因,明确提出了社区治理法治化应当遵循程序法定、公平正义、以人为本等基本原则,综合采用加强社区治理法治意识培育、加快社区成员角色转换、建立社区治理法治体系和增加社区治理资源投入力度等对策。通过以上研究,论文所提出的全面依法治国背景下社区治理法治化的四大举措,社区党组织、自治组织、营利组织、社会组织和社区居民"五位一体"社区治理法治化建设新思路,有利于弥补传统社区治理研究的不足,有利于从社区层面推动社会治理法治化的理论与实践研究,有利于中国特色社会主义社会治理体系的不断丰富和完善。
[Abstract]:The "decision of the CPC Central Committee on promoting the Rule of Law in an All-round way" adopted by the fourth Plenary session of the 18 CPC Central Committee points out that the foundation for comprehensively promoting the rule of law lies at the grass-roots level. As the most basic unit of social organism, the community needs to explore and practice the legalization of community governance in the process of its own development: to establish the thinking of the rule of law and to cultivate the consciousness of the rule of law. Adhere to the good law of governance, adhere to the rule of law, constantly enhance the concept of the rule of law of residents, create a community environment for the rule of law, construct a good order of community governance, strengthen the rules of the rule of law procedures, innovation of community governance model, solve community common problems. We will comprehensively promote the work of running the society according to law in a down-to-earth manner and better promote the economic, social and cultural development of the community. To improve the living standards of community residents and promote the innovation of community governance model. This paper takes the concept of socialist rule of law as the perspective, using the method of literature, comparative analysis. On the basis of clarifying the basic concepts of community governance by law and comprehensive rule of law and their mutual relations, this paper discusses the current situation of community governance by law. The problems and reasons are analyzed comprehensively, aiming at the lack of the ruling ability of the community party organization, the change of the role of the autonomous organization, and the lack of legal supervision of the profit organization in the community governance work of our country at the present stage. Five major problems, such as abnormal professional services of social organizations and insufficient participation of social residents in the rule of law, have been thoroughly searched for the traditional community "rule by man" thought is difficult to eliminate, the community governance policies and regulations are not perfect, and the role of community members is not adapted. The subjective and objective reasons such as insufficient input of community governance resources, clearly put forward that community governance by law should follow the basic principles of legal procedures, fairness and justice, people-oriented and other basic principles. Comprehensive use of strengthening community governance awareness of the cultivation of the rule of law, accelerate the role of community members to change, establish community governance of the rule of law system and increase the intensity of community governance resources, and so on. Through the above study. The paper puts forward four measures of community governance by law under the background of comprehensive rule of law, community party organizations, autonomous organizations, profit organizations. Social organizations and community residents "five-in-one" community governance construction of new ideas, is conducive to make up for the deficiencies of traditional community governance research. It is propitious to promote the theory and practice research of social governance by law from the community level, and to enrich and perfect the socialist social governance system with Chinese characteristics.
