从报复到矫正的历史经典——1870年美国监狱大会《原则宣言》的考据

【摘要】：《原则宣言》是首届美国监狱大会的重要成果。目前,国内外学界关于《原则宣言》的研究和分析不仅数量不多,缺乏系统性,且多是停留在对二级文献的转引层面上,并出现了一些望文生义、以讹传讹、影响学习和研究的问题。文章为正其名,在确定了《原则宣言》的真实原始文本基础上,对其完整翻译并进行整理;指出现存问题根源所在,并从刑法目的、罪犯改造、监狱管理等几个方面具体地阐述了《原则宣言》的主要内容;从道德理念、制度理念、人的主体性等几个层面论述了该文本的重要历史贡献;首次对《原则宣言》进行了全面的理论研究。
[Abstract]:The Declaration of principles is an important achievement of the first American Prison Congress. At present, the research and analysis of the Declaration of principles in domestic and foreign scholars is not only a small number, but also a lack of systematic. And most of them stay on the level of citation of the secondary literature, and there are a number of problems, which affect learning and research. On the basis of determining the true original text of the Declaration of principles, the complete translation and arrangement are carried out. This paper points out the root of the existing problems, and expounds the main contents of the Declaration of principles from the purposes of criminal law, the reform of criminals, the management of prisons and so on. This paper discusses the important historical contribution of this text from several aspects, such as moral idea, system idea, human subjectivity and so on. A comprehensive theoretical study of the Declaration of principles was carried out for the first time.
