新中国成立六十年青年法治观念的变迁与启示

【摘要】：随着我国社会民主法治建设的不断深入发展,法律制度健全和司法体制改革都取得了令人瞩目的辉煌成绩,简单的回顾历史便不难发现每一次法治进程的突破性发展都伴随着激烈的观念争论与革新,没有科学合理并且不断走向成熟的法治观念作为指导,我国的法治建设很难在今天取得这样的成绩。青年代表着国家与社会的未来,青年的观念在一定程度上预示着未来社会的主流观念。受到近来若干不同主题的以新中国成立六十周年为时间跨度的学术研究的启发,本文将对这一时间跨度内来不同时期的青年群体法治观念的变迁轨迹做一粗略的梳理,并力求在此基础上提出此变迁过程对于青年法治素质教育、青年法治观念教育、青年社会关注、青年创业等若干现实问题的启示。具体从以下几方面展开: 首先,本文将对现代法治的内涵和法治观念的含义进行理论分析和界定,明确研究中所涉及的基础性概念的内涵和外延; 其次,根据理论界定所得出的概念内涵和外延,本文进一步分阶段纵向梳理新中国成立六十年以来青年法治观念的变迁轨迹,总结归纳出青年法治观念在这六十年历程中,从萌芽到经历挫折再到高速发展并不断走向成熟的变迁过程; 最后,本文从新中国成立六十年青年法治观念的变迁轨迹中总结出其变化发展的一般规律和特殊之处,以此为依据提出若干具有科学性、时代性和实践性的现实启示,以求对青年法治教育、青年创业等现实社会中的热点问题从法治观念层面起到一定的帮助和引导作用。
[Abstract]:With the continuous development of the construction of democracy and rule of law in our country, the perfection of the legal system and the reform of the judicial system have made remarkable achievements. Simply looking back on history it is not difficult to find that every breakthrough development of the process of rule of law is accompanied by fierce debate and innovation of ideas, there is no scientific and reasonable and constantly towards the mature concept of the rule of law as a guide. The rule of law construction in our country is very difficult to make such achievements today. Youth represent the future of the country and society. To some extent, the concept of youth indicates the mainstream concept of the future society. It is inspired by a number of recent academic studies on the 60 anniversary of the founding of New China. This article will make a rough combing of the changing track of the concept of the rule of law of the youth group in different periods in this time span, and try to put forward the change process for the quality education of the youth ruling by law on the basis of this. The enlightenment of some practical problems, such as the education of the concept of the rule of law of youth, the concern of the youth society, the youth entrepreneurship, etc., are carried out from the following aspects: First of all, this paper will analyze and define the connotation of the modern rule of law and the meaning of the concept of the rule of law, and make clear the connotation and extension of the basic concepts involved in the research. Secondly, according to the theoretical definition of the concept of connotation and extension, this paper further sorted out the concept of youth rule of law since the founding of New China in the past 60 years. Summing up the concept of youth rule of law in the course of these 60 years, from germination to experience setbacks to rapid development and continue to mature process of change; Finally, this paper summarizes the general law and special place of the concept of the rule of law of the youth in the 60 years after the founding of New China, and puts forward some scientific methods based on it. The realistic enlightenment of the times and practice aims to help and guide the hot issues in the real society such as the education of the rule of law and the youth entrepreneurship from the viewpoint of the rule of law.
