美国政府信息公开诉讼中的律师费制度及启示

【摘要】：为了实现公众对《信息自由法》的执行、惩罚试图阻挠合法信息申请的行政机关、消除诉讼当事人面临的经济障碍,美国国会在1974年修改《信息自由法》时引入了律师费条款:即在《信息自由法》诉讼中,如果原告已经实质上胜诉,法院可以裁决政府承担合理的律师费和其它诉讼费。在《信息自由法》案件中,律师费的裁决是否适当,取决于一个两步走的调查:第一步,原告必须通过其实质上胜诉以证明其"有资格"获得律师费;第二步,原告必须证明其"有权利"获得律师费。
[Abstract]:In order to achieve public enforcement of the Freedom of Information Act, to punish administrative organs that attempt to obstruct legitimate information applications, and to remove the financial obstacles faced by litigants, When Congress amended the Freedom of Information Act in 1974, it introduced a clause on lawyers' fees: that is, in a Freedom of Information Act lawsuit, if the plaintiff had substantially won the case, The court may decide that the government bears reasonable legal and other costs. In the Freedom of Information Act case, the appropriateness of the decision depends on a two-step investigation: the first step. The plaintiff must prove that he is "entitled" to the lawyer's fee by his substantial victory; the second step is that the plaintiff must prove that he "has the right" to receive the lawyer's fee.
