科学发展观视阈下中国特色法治建设研究

【摘要】：纵观新中国前30年和改革开放后30年整体发展和现实状况,我国法治建设走出一条艰难曲折、成绩显著而又独具特色的发展道路。在完成法治建设拨乱反正的基础上,逐步确立了“依法治国,建设社会主义法治国家”的战略目标,扎实推进法治建设的现代化、制度化进程。科学发展观的提出,为社会主义法治建设提供了一个重要的理论武器。它瞄准了中国特色法治建设的价值定位,唤醒了中国特色法治建设的创新基因,为中国特色法治建设提供了一种全新的发展视角。面对新世纪,开展科学发展观视阈下中国特色法治建设研究具有重大的理论价值和深远的现实意义。在发展方式上,“以人为本”的新法治理念,全面改造和提升传统的“以法为本”旧观念,实现了社会主义法治发展方式的深层次转变。在理论指导上,科学发展观是马克思主义中国化的最新理论成果,全方位指导着中国特色社会主义法治建设。在现实作用上,深入贯彻落实科学发展观,加快推进依法治国基本方略,是中国特色社会主义法治建设的迫切要求。本文的研究内容分为四大部分。第一部分(第1章)是绪论,主要介绍选题的目的和意义、国内外研究现状、研究内容以及研究方法;第二部分(第2章)是对新中国成立以来、特别是改革开放以来中国特色法治建设的发展脉络进行系统的梳理,进而总结法治建设所取得的丰硕成果以及法治建设中存在的一些问题。第三部分(第3章)阐述了科学发展观视阈下的中国特色法治建设,通过价值创新展现法治建设“以人为本”、步骤创新体现法治建设“全面协调可持续发展”、方法创新彰显法治建设“统筹兼顾”这三个方面阐述科学发展观对中国特色法治建设的创新基点。第四部分(第4章)阐述了科学发展观指导中国特色法治建设的现实意义,即是增强党的执政能力和执政水平的迫切需要,是建设社会主义法治国家的必然要求,是构建和谐法治的内在要求,是人民当家作主的重要体现。第五部分(第5章)是结论和讨论,是对全文的总结和理论概括。
[Abstract]:Throughout the first 30 years of New China and 30 years after the reform and opening up of the overall development and reality, China's rule of law construction out of a difficult and tortuous, remarkable achievements and unique development path. The strategic goal of "running the country according to law and building a socialist country ruled by law" has been gradually established, and the modernization and institutionalization of the construction of the rule of law have been firmly promoted. It aims at the value orientation of the construction of the rule of law with Chinese characteristics and awakens the innovative gene of the construction of the rule of law with Chinese characteristics. For the construction of the rule of law with Chinese characteristics to provide a new perspective of development. Facing the new century, It is of great theoretical value and far-reaching practical significance to carry out the research on the construction of the rule of law with Chinese characteristics from the perspective of the scientific development view. In the way of development, the new concept of "people-oriented" rule of law, the comprehensive reform and promotion of the traditional "law-based" old concept, Under the guidance of theory, the scientific development view is the latest theoretical achievement of Marxism in China, which guides the construction of socialist rule of law with Chinese characteristics in all directions. It is an urgent requirement for the construction of the rule of law of socialism with Chinese characteristics to carry out the concept of scientific development and accelerate the basic strategy of governing the country according to law. The first part (chapter 1) is the introduction, which mainly introduces the purpose and significance of the topic, the current research situation at home and abroad, the research content and the research methods; The second part (Chapter 2) is a systematic analysis of the development of the rule of law construction with Chinese characteristics since the founding of New China, especially since the reform and opening up. The third part (chapter 3) expounds the construction of the rule of law with Chinese characteristics from the perspective of the scientific development concept, and then summarizes the fruitful achievements made in the construction of the rule of law and some problems existing in the construction of the rule of law. Through the value innovation to show the "people-oriented" of the rule of law construction, step innovation reflects the rule of law construction "overall coordinated and sustainable development", the method of innovation to highlight the rule of law construction "overall consideration" of the three aspects of the scientific concept of development to China. Part 4th (Chapter 4) expounds the practical significance of the scientific concept of development to guide the construction of the rule of law with Chinese characteristics. That is, it is the urgent need to strengthen the ruling ability and the ruling level of the Party, the inevitable requirement of building a socialist country ruled by law, and the inherent requirement of building a harmonious rule of law. Part 5th (Chapter 5) is the conclusion and discussion, the summary and theoretical summary of the full text.
