垄断行业高薪酬的法律规制问题研究

【摘要】:垄断行业高薪酬是指垄断行业的薪酬水平因受行业性质和薪酬制度的影响而明显超出市场正常水平的一种经济现象。近几年来,垄断行业的高薪酬现象一直饱受公众的批评,并且成为当前收入分配改革的重点领域。垄断行业的薪酬水平过高,就会拉大社会的贫富差距,变相侵占公众的福利,降低市场资源的配置效率,不利于和谐社会的构建。由于当前我国的薪酬监管法律不够健全,导致垄断行业高薪酬问题长期得不到有效解决。所以,积极完善相关法律制度,对规制垄断行业的高薪酬尤为重要。针对垄断行业高薪酬形成原因的复杂性、薪酬监管环节的多元性,笔者提出了在薪酬的分配环节要完善工资总额预算管理制度、垄断行业高管的限薪制度、个人所得税制度等法律措施以实现对高薪酬的直接规制;在薪酬的形成环节要完善反垄断制度、价格监管制度、垄断行业的红利上缴制度等法律措施来控制垄断利润的产生与支配,从而达到间接规制垄断行业高薪酬的目的。 除引言与结语外,本文共分为四个部分。 第一部分是本文的论证前提。通过探讨垄断行业高薪酬的表现、产生原因以及危害,使我们对垄断行业高薪酬有一个总体性的认识,总结出了垄断行业高薪酬具有的表现形式多样,产生原因复杂,危害深远的特点。 第二部分详细考查了我国当前规制垄断行业高薪酬的法律制度。通过考察,指出了这些法律制度没有对垄断行业高薪酬的制度根源进行规制,只是对薪酬的分配过程做了一些技术上的调整,并且存在许多缺陷,因而不可能从根本上消除垄断行业高薪酬现象。 第三部分主要介绍了国外防范垄断行业高薪酬的法律制度以及对我国的经验借鉴。通过考察国外在垄断行业中的反垄断制度、价格监管制度和垄断行业的红利上缴制度,为我们打开规制垄断行业高薪酬的新视角,即我国应当采取法律措施来控制垄断利润的产生与支配,才能消除高薪酬产生的经济基础,从而实现间接规制高薪酬的目的。 第四部分是本文的结论。通过对比中外的法律实践,并且考虑到我国垄断行业高薪酬存在的特殊情况,提出了规制垄断行业高薪酬的具体对策:需要构建一个对高薪酬进行直接规制与间接规制相结合的法律规制体系。这样不仅可以防范垄断行业薪酬水平的过快增长,还可以消除垄断行业高新酬产生的制度根源。
[Abstract]:High pay in monopoly industry is an economic phenomenon that the pay level of monopoly industry is obviously exceeded the normal level of market because of the nature of industry and salary system. In recent years, the phenomenon of high salary in monopoly industry has been criticized by the public. And it has become a key area of the current income distribution reform. If the pay level of monopoly industries is too high, it will widen the gap between the rich and the poor in the society, encroach on the welfare of the public in disguise, and reduce the efficiency of the allocation of market resources. It is not conducive to the construction of a harmonious society. Because the current salary supervision law in our country is not perfect enough, the problem of high salary in monopoly industry can not be effectively solved for a long time. Therefore, we should actively improve the relevant legal system. In view of the complexity of the reasons for the formation of high salary in monopoly industry and the diversity of compensation supervision, the author puts forward that the budget management system of total salary should be improved in the distribution of salary. Monopoly industry executives pay limit system, personal income tax system and other legal measures to achieve the direct regulation of high pay, in the formation of compensation to improve the anti-monopoly system, price supervision system, The monopoly industry's dividend payment system and other legal measures to control the production and control of monopoly profits, so as to achieve the goal of indirectly regulating the monopoly industry's high salary. In addition to the introduction and conclusion, this article is divided into four parts. The first part is the premise of this paper. By discussing the performance, causes and harm of high pay in monopoly industry, we have a general understanding of high pay in monopoly industry. The characteristics of high salary in monopoly industry are summarized, such as various forms, complicated causes and far-reaching harm. The second part examines the current legal system of high pay in monopoly industry in China. Through investigation, the author points out that these legal systems do not regulate the system root of high pay in monopoly industry. Only some technical adjustments have been made to the process of salary distribution, and there are many defects, so it is impossible to eliminate the phenomenon of high salary in monopoly industry. The third part mainly introduces the foreign legal system of preventing the high salary of monopoly industry and the experience of our country. By investigating the antitrust system, the price supervision system and the dividend payment system of monopoly industry, the third part of this paper introduces the foreign legal system of preventing the high salary of monopoly industry and the experience of our country. For us to open up a new angle of view of regulating high pay in monopoly industry, that is, our country should take legal measures to control the generation and control of monopoly profits, in order to eliminate the economic basis of high pay and thus achieve the purpose of indirectly regulating high pay. Part 4th is the conclusion of this paper. By comparing the legal practice between China and foreign countries, and considering the special situation of high salary in monopoly industry of our country, This paper puts forward the concrete countermeasures to regulate the high salary in monopoly industry: it is necessary to construct a legal regulation system which combines direct regulation and indirect regulation of high salary, which can not only prevent the excessive increase of salary level in monopoly industry. It can also eliminate the system root of high-new pay in monopoly industry.
