古罗马城镇化建设保障立法探究

【摘要】：在我国城镇化的进程中产生了许多的社会问题。其实,这些问题早在古代罗马的城镇化进程中就有所体现,并被罗马人运用法律的手段予以解决。事实上,罗马人的城镇化从共和早期开始,在奥古斯都时代开始向行省发展,于元首制末期衰退。其主要动因是政治上的罗马化要求。这一进程在罗马共和国时期的体现是63部立法文件,可以分为积极的和消极的两大类。这些立法文件中,起积极作用的涉及到建立城市的命令、建设标准、管理规则和城市间纠纷的处理四类,起消极作用的分为禁止奢侈行为、限制人口流动和身份造假三种。它们为我们提供了一副罗马共和国城镇化运动的完整蓝图,并为我国当下的城镇化进程提供了宝贵的经验。
[Abstract]:Many social problems have arisen in the course of urbanization in our country. In fact, these problems have been reflected in the process of urbanization in ancient Rome and solved by the Roman people by means of law. The urbanization of the Romans began in the early Republican period and began to develop into a province in the days of Augustus. In the end of the head system, the main motive was the political Romanization demand. This process was embodied in 63 legislative documents during the period of the Roman Republic, which can be divided into two categories: positive and negative. There are four categories that play a positive role: the order to establish a city, the standard of construction, the rules of management, and the handling of disputes between cities. The negative ones are divided into the prohibition of extravagant behavior, They provide us with a complete blueprint for the urbanization movement of the Roman Republic and valuable experience for the current urbanization process of our country.
