【摘要】：随着时代的进步和社会的发展,广泛地让公民参与到立法过程中来,形成“开门立法”的良好局面,已然成为民主法制建设下不可逆挡的历史潮流。我国的地方立法顺应了社会发展的趋势,开展了形式多样的公民参与实践。本文以此为切入点,深入思考了完善公民参与地方立法机制这一既有深厚理论又有丰富实践意义的课题。本文正文一共分为四个部分。第一部分为地方立法中公民参与机制的一般理论,文章首先对地方立法的概念进行了必要的界定和法理分析,明确了本文探讨的内涵所在。并在此基础上分析了地方立法的特点和其存在的积极作用。第二部分揭示了公民参与在地方立法中面临的各种问题并针对问题的表征深入分析了内在的原因,以便更清晰地认识我国地方立法中公民参与的现状,为文章第四部分的写作奠定基础。第三部分以美国、英国、日本为例介绍了国外地方立法中公民参与机制的相关实例并分析了其可借鉴之处,为下文探讨完善我国公民参与地方立法机制做了铺垫。第四部分是本文的重点章节,该章节针对上文提出的缺陷,尝试从制度体系切入,并从完善公民参与规则、健全立法信息公开、提升公民参与热情、设立社区立法助理四大制度入手,拟构建一个相对完整的公民参与体系,以期公民参与在地方立法中能畅通运行。
[Abstract]:With the progress of the times and the development of society, citizens are extensively involved in the legislative process, and a good situation of "open door legislation" is formed. It has become an irreversible historical trend under the construction of democracy and legal system. The local legislation of our country conforms to the trend of social development and develops various forms of citizen participation practice. This paper thinks deeply about the topic of perfecting citizen's participation in local legislation mechanism, which has both profound theory and rich practical significance. This text is divided into four parts altogether. The first part is the general theory of citizen participation mechanism in local legislation. This paper clarifies the connotation of this paper, and analyzes the characteristics of local legislation and its positive role. The second part reveals all kinds of problems that citizen participation faces in local legislation and analyzes the internal reasons in order to understand more clearly the status quo of citizen participation in local legislation in our country. To lay the foundation for the writing of the 4th part of the article. The third part takes the United States, Britain and Japan as an example to introduce the relevant examples of the mechanism of citizen participation in foreign local legislation, and analyzes its reference, which paves the way for the following discussion and improvement of the mechanism of citizen participation in local legislation of our country. The 4th part is the key chapter of this article, this chapter aims at the defects mentioned above, tries to cut into the system, and from perfecting the rules of citizen participation, perfecting the publicity of legislation information, promoting the enthusiasm of citizen participation, Starting with the establishment of four systems of community legislative assistants, this paper intends to construct a relatively complete system of citizen participation, with a view to enabling citizen participation to run smoothly in local legislation.
