中国改革与法治:如何突破瓶颈——中国政法大学终身教授江平先生专访

【摘要】：江平教授是当代中国具有重要影响力的法学家之一,关注国家改革命运与法治进程,坚持市场经济、权利本位与依法治国,是他长期以来的标志性学术观点和基本定位。中国的改革已经持续了36年,当初改革的受益者逐渐步入"暮年","继承与接班人问题"也再一次困扰执政者如何选择未来的制度建构,于是人们再一次讨论政府与市场、再一次讨论政府与企业、再一次讨论改革与法治的关系。为了让读者能够进一步理解江平教授对上述问题的核心思想和见解,尤其是近年来他关于改革瓶颈与法治出路的思想观点,近日,云南大学法学院赵忠龙博士受本刊杨文德编辑的委托,在北京对江平教授进行了深度访谈。在访谈中,江平教授回顾了自己与中国法制进程的点滴故事,分析了当代中国改革的瓶颈,对改革与法治的关系、对中国改革开放的前景提出了自己独到的看法。"法治精神"、"权利本位"、"爱国情怀"是理解江平教授学术志业和基本思想的一根主线。
[Abstract]:Professor Jiang Ping is one of the most influential jurists in contemporary China. He pays close attention to the fate of national reform and the process of ruling by law, and adheres to the market economy, the right standard and the rule of law. He has long been the hallmark of his academic views and basic positioning. China's reform has lasted 36 years. At the beginning, the beneficiaries of the reform gradually stepped into the "old age", and the question of "succession and succession" again puzzled the rulers how to choose the future institutional construction. So people again discussed the government and the market, and again discussed the government and the enterprise. To enable readers to further understand Professor Jiang Ping's core ideas and views on the above issues, especially his views on the bottleneck of reform and the way out of the rule of law in recent years, Dr. Zhao Zhonglong, School of Law of Yunnan University, was commissioned by Yang Wende, an editor of our journal, to conduct an in-depth interview with Professor Jiang Ping in Beijing. In the interview, Professor Jiang Ping reviewed his little story about the process of legal system in China. This paper analyzes the bottleneck of the reform in contemporary China, the relationship between the reform and the rule of law, This paper puts forward his own unique views on the prospect of China's reform and opening up. "the spirit of rule by law", "right standard" and "patriotism" are the main lines of understanding Professor Jiang Ping's academic ideals and basic thoughts.
